Patel and Mau Jailed

Former Post Fiji Limited Chairman Mahendra Patel and former Managing Director, Peni Mau have both been sentenced to jail for abuse of office.

Patel has been sentenced to 12 months in jail for allowing the purchase of the Seiko clock from Prouds, a company owned by him and failing to disclose his interest and relationship with the company.

And Mau has been sentenced to 9 months in jail for approving the purchase of the clock for $75,000 without following proper procedures and without the approval of the Post Fiji board.

Their lawyers immediately filed for an appeal and applied for bail but Justice Daniel Goundar denied it; they will start their prison sentences today at Korovou Prison.

  8. I feel for Mahendra Patel but this is the result of allowing yourself to be corrupted by the real culprit, in this case, Peni Mau. Justice finally caught up to Peni unfortunately a pioneer businessman in Fiji got caught in the web too. As the saying goes, "The choices you make determine your destiny".

  9. This is just ridiculous. All his life the great Mr Mahendra Patel has devoted in building Fiji. It is obvious, his gain was there, but if it wasn't for him, Fiji would still be like other pacific island nations.

    His group has contributed so much and has always been a developing partner for the Fijian economy, and is this what Fiji gives him in return. Shame on our pathetic judicial system.

    Well, there are many others on the line now.. so for now, just one piece of advice to the business community... shut all their shops and head overseas... Infact Motibbhai group should overnight shut all its business and send home the thousands it is feeding.. lets see what the cunning airse can do.

    So the great question, who is next in the line?? Keep guessing

    Dear Editor,

    Is Vanuatu the last bastion for Pacific Islanders, especially since the Pacific Islands Forum Secretariat is toothless? Why else would Australia attack the banking system? Simple destabilize the biggest incentive Vanuatu has to offer and the MSG ship may sink.
    Australia’s foreign policy in the Pacific has failed. It tried dangling the aid carrot, but we woke up to it and realized that it came with strings attached i.e. a big chunk of the aid money goes back to Australia in the form of salaries to overpaid consultants who really should be put to pasture.
    Then, Australia tried to be the Sheriff of the Pacific and used the stick by threatening Fiji’s Bainimarama and his gang.
    Attack the solidarity of the Melanesian brotherhood by attacking the financial institutions. Two of Vanuatu’s main banks are Westpac and ANZ, both Australian banks.
    Through the long arm of the Australian Tax Office (ATO). By accessing the Accounts information of all Australian residents and citizens, who hold accounts with, first the ANZ bank here in Vanuatu, the Australians hope to see their citizens and residents pull their money out of here and put it somewhere more friendly to their interests such as Samoa.
    Expected result of Australia’s new strongarm tactic? Offshore companies and individuals pull their money out and thus bringing Vanuatu to its knees.

    VANUATU SHOULD FOLLOW FIJI AND-
    1 . DECLARE AUSTRALIA’S HIGH COMMISSIONER PERSONA NON GRATA
    2 . INFORM ANZ VANUATU THAT SHOULD IT DISCLOSE THE INFORMATION PERTAINING TO ITS AUSTRALIAN DEPOSITORS AND ACCOUNT HOLDERS, THEN ITS BANKING LICENSE WILL BE REVOKED, ITS EXPATRIATE STAFF DEPORTED, THE POSSIBLE PROSECUTION OF ITS MANAGERS AND ITS OPERATIONS NATIONALISED
    3 . AS A SIGN THAT THE GOVERNMENT OF VANUATU IS SERIOUS, IT SHOULD NOT ALLOW ANY NON.RESIDENT, NON PACIFIC ISLANDER EXPATRIATE STAFF TO COME IN TO WORK IN VANUATU WHILST THIS MATTER IS STILL PENDING. FOR EXAMPLE, ANZ REGULARLY BRINGS IN A EUROPEAN NATIONAL BASED OUT OF SINGAPORE TO WORK IN PORT VILA FOR A FEW DAYS AT A TIME EVERY COUPLE OF MONTHS. IT’S NOT ENOUGH THAT THE AUSTRALIANS ARE CRAWLING ALL OVER THE PACIFIC, NOW THEY ARE HIRING EUROPEANS TO DO THEIR DIRTY WORK FOR THEM.

    Section 45 of the Financial Institutions Act, Cap 254 deals with unsound or unsafe practices. Under s45(1) if the Reserve Bank is of the opinion that a licensee
    (a) is following unsound or unsafe practices in the conduct of its banking business that are
    (i) likely to jeopardise its obligations to its depositors or other creditors or
    (ii) likely to adversely affect the operation or stability of the financial system in Vanuatu or
    (b) has contravened or failed to comply with the terms and conditions of its licence or any of the provisions of this Act
    the Reserve Bank may issue a directive to the licensee.

    It is safe to say that allowing the ATO access would be in breach of section 45(a) and (b). Therefore, the Reserve Bank should issue a directive requiring ANZ to desist from supplying the ATO with any information relating to its Australian domiciled depositors and to take whatever action is required to achieve this within the next 30 days. Failure on ANZ’s part to comply with the Reserve Bank’s directive will result in the revocation of its license pursuant to s17(e) of the Act and/or the prosecution of its expatriate officers who are based in Vanuatu.
    The Attorney General should, pursuant to s60 of the Act, institute proceedings here in Vanuatu against ANZ to restrain it from supplying the information. Whilst this may be purely academic since the ATO can access the information from Melbourne, perhaps a more prudent option would be to institute criminal proceedings against the head of ANZ here in Vanuatu.
    For the avoidance of any doubt the Reserve Bank should send Westpac a warning that should it also succumb to the ATO, it too is in danger of losing its license, its expatriate staff deported, its General Manager prosecuted and its operations nationalised.

    No matter what FICAC does it will still be viewed as an illegal Gestapo unit operating under the guidance of an illegal PM.This is because the current law only protects an elite and corrupt group of coup thugs

  22. Only way Mahen Patel can save himself and clear his name is by showing the invoice and payment history with bank details.

    Because if as said that the profit made was only about $1500 from the transaction, then indeed this amount is insignificant in terms of commercial interest.

    BUT he chose not to provide that evidence, hence his story is worth a 100 lies and jail is not a bad idea.

    His wealth gained and investments made were they out of favour!!

Well,well,well.talk about Goundar moving the goal post.I also read FICAC withdrew the charge against Tuisolia for not displaying his business license......gonei, bau vaka cava tu na bavulu ra tu qori i FICAC...iTaukei.. o ira na FICAC prosecutors are from Sri Lanka + Sri Lankan judges = CORRUPTION ni Sri Lanka...Since Anthony Gates has a thing for Sri Lankan toy boys, wouldn't be surprised if one of his new appointees is playing a dual role.     Just this week an employee at Lautoka Rural Office declined Taxi Permits even after being offered a bribe.

    Suncourt owner in jail.

    A lesson needs to be set and that is corruption will not be tolerated in Fiji.

Simple originating summons should be done as facts not in dispute. No tender was called for. Application of law can be used from Mac case. Go on FICAC. Show some muscles yaar!

Now is probably the time for RBF increase checks of ‘dubious" transfers overseas and Boarder Police vigilant in checks of currencies carrier across the boarders. Oh… and the black money market in our streets must be thieving now. Conversely, former Fiji residents and others buying Fiji currencies abroad taking advantage of this surge in Aussie dollars and other strong currencies is …a concern. How do they do it? do not ask me!
