Former FICAC staffer: Fiji regime interfered with prosecutions

MANIPULATED FICAC: Aiyaz Sayed Khaiyum.



Emerging proof of what many have been saying for some time: that Aiyaz Sayed Khaiyum pick and chooses who the Fiji Independent Commission Against Corruption prosecutes. The revelation has come from the inside, from one of the three Sri Lankan lawyers who 'left' Fiji recently. Mahadwa Tenakoon says the regime steered who the Commission went after and that people were prosecuted for political reasons. We say something more basic has been at play, too. Money. According to a source, Khaiyum's office recently approached a well-known Fiji lawyer with a deal for the early release of Motibhai's Mahendra Patel for $FJ200,000. Our source says the offer is "generally available" to those in Patel's position who can afford the early release fee.

A former senior staffer with the Fiji Independent Commission Against Corruption says people in the country have been prosecuted for political reasons.

Madhawa Tenakoon held a senior position with FICAC but was dismissed by the military regime along with two other senior colleagues.

He alleges the government was directing the Commission to pursue investigations, when there was no basis for it to do so.

Mr Tenakoon says there's no rule of law and no democracy in Fiji while the military is running the legal system.

The Sri Lankan lawyer told Radio Australia's Pacific Beat he originally accepted the job of prosecutor because he was told he'd be taking on a pioneering role in the fight against corruption in Fiji.

He says after about six months in the job he realised there was government interference in pursuing some cases and ignoring others.

Fiji's Attorney General has rejected the claims.

Aiyaz Sayed-Khaiyum says Mr Tenakoon was sacked for poor-performance.

The Attorney General says the United Nations is quite happy with the progress being made with Fiji's anti-corruption legislation.

Meanwhile, one of the people pursued by the Independent Commission Against Corruption, Imrana Jalal (pictured right), says she hopes to file a malicious prosecution case based on what Madhawa Tenakoon has alleged.

    The people of Nairai in Lomaiviti have pleaded with Prime Minister Commodore Voreqe Bainimarama to fast-track developments on their island before the 2014 General Elections.
    The plea is because they doubt the commitment of the replacement government and return of politicians. Natauloa Village headman Malani Vosacolati said they were worried that development projects earmarked for the island would not be carried out when the next government would be elected.

    "The General Elections are near and if work is not carried out now, then we are not sure whether it will be done by the next government," Mr Vosacolati said.

    Tui Tovulailai, Ratu Inosi Ratete added by praising the work being carried out by the Bainimarama Government. He said this was made possible because of Government’s great leadership.

    “We want to thank you (PM) for remembering us. We have heard of the great work that you are doing around the country and we are fortunate to be part of it,” Ratu Inosi said.

    Commodore Bainimarama yesterday reiterated his Government’s commitment to assisting and improving the lives of people living in rural areas.

    He was at Nairai to inspect the site for the new jetty at Tovulailai. He was accorded a full traditional welcome ceremony.

    After a talanoa session with the people, the delegation led by Commissioner Eastern Lieutenant-Colonel Neumi Leweni left for Koro Island at about 11am on board the MV Dausoko, while Commodore Bainimarama went on to visit the Nautauloa Beach Resort, which was yet to operate because of a land dispute.

  55. to answer why Sahu Khan was not extradited: I believe Sahu Khan is the uncle of Nazaat Shameem. Naz's late mother was a Sahu Khan and correct me someone, but I think Naz's late mother is Sahu Khan's sister. So, he will not be extradited like they are trying to do with Ratu Mara.

From very reliable sources, when FICAC cant find anything to charge a person, the stupid interrogating FICAC people can ask the same questions over and over again, today, tomorrow, in two weeks, in a month. Thats how bad it is. And the poor people being interrogated cant do anything because we are under military rule and thats just how it is.

    I am aware that Military council except PM wanted FICAC to investigate ASK on his Tappoo land deal. This was a quid pro quo that ASK and Tappoo worked out so that Aiyaz covered up everything for Tappoo in FNPF as far as Penina Ltd / Tappoo City project was concerned.

    Tappoo did a lot of double dipping have imported glass fronts, air cons and many other items by itself and charged FNPF inflated prices. Tappoo also was allowed to import all these at concession rate of duty. Can ASK deny any of this!!

    FICAC also wanted to investigate me for millions of dollars of fees that I collected on the Rewa Dairy restructure. I went running to my nephew and he immediately instructed FICAC not to do anything.

    The boci PM knows everything and both PM & ASK are leaking each others arses and covering up one another.

    A Sri Lankan lawyer who's has spoken out about political interference in Fiji's judicial system says he has documentary proof of high level interference.

    Radio Australia's Pacific Beat aired allegations made by Madhawa Tenakoon, who held a senior position with Fiji's Independent Commission Against Corruption but was dismissed by Fiji's military government.

    Mr Tenakoon says the government interfered in prosecutions by directing the Commission to launch certain investigations, while also directing some cases be ignored.

    Fiji's Attorney General, Aiyaz Sayed-Khaiyum, says Mr Tenakoon was sacked for poor performance and suggests the former FICAC employee is trying to raise his profile in a bid to boost his career.

    Mr Sayed-Khaiyum also challenged Mr Tenakoon to produce some proof.

    Mr Tenakoon told Pacific Beat when a democratic government returns to power in Fiji he will produce all the documentary proof he has kept from his time with FICAC.

The Sri Lankan Lawyer who finally revealed the truth publicly through the media is a champion given that the interference by the illegal AG was doing the rounds during kava sessions in some government office way back in 2009/2010. Remember the removal of former DPP John Rabuku and followed by the Army officer who replaced him and than followed by Senior Legal Officer Toganivalu and others...this was the indicator that was justifying the rumours at the time. Now it is a fact because it has come out from a credible source who was actually affected by it. This Sri Lankan lawyer is a Champion...what about the others? sorry you have to be out of the country to reveal it all given the PER and all the spies and Liu Muri/Backbites that is all over the place. So for all of you who have something to reveal get out of the country now and don't waste your time towing the line for the illegal regime....

    Since this Column is about contracted Sri Lankans in Fiji who are mostly in the Judicial Ssytem, this is the best place to raise the issue of the Chief Registrar, Irani Ravithai so and so...or whatever her name is.

    She was on Fiji TV news this evening on the issue of arrears of fines, etc. She really looks serene in her traditional dress, lipstick and make-up making her looking younger than her real age. However be aware that it is the face that keeps the AG enthralled and captivated forcing the AG to keep her as CR irrespective of poor performance.

    IRANI; you really look foolish on TV...while your English expression is lousy, you cannot even speak in public with confidence though you were definitely reading from a prepared script.

    This is the trouble with being thrust into a position that you know very little about though you may be a lawyer but one who had struggled from base clerical work.

    Oh, yes! You IRANI is ther one who has been makiing life difficult for your own countrymen in the judicial and legal system here in Fiji.

    You have been manipulating everything in the judicial system for the AG in the process victimising FIJIAN I TAULEI in the Judicial Department...Evidence? Oh, Yes! anypne who wishes to confirm this just find out how many FIJIAN I TAUKEI CIVIL SERVANTS IN THE JUDICIAL DEPARTMENT WHO HAVE BEEN POSTED AWAY FROM THERE (10 OR MORE) DURING THE SHORT TIME OF IRANI AS CR....THEN PUTTING FIJI INDIANS THROUGH PROMOTION IN POSITIONS SHE HAD FORCED VACANT......

    This is what JVB wants to be done to us Fijian I Taukei in Government.

    U all know that Right Rev. Epeli Ratabacaca was in the media early this month over certain allegations of misconduct uncharacteristic of a Man Of GOD.

    First, my personal advice to all bloggers that this man is a man of GOD and I would not want any of us to think otherwise.

    What I wish to raise is, this was not just an attempt to ruin Rev. Ratabacaca's image,good name, character, his life and that of his family.

    This was also an attempt to break up the All Nations Christian Fellowship (ANCF) Church the members of which are mostly from the Fiji Military, Fiji Police, Ex Military and Ex Police, are mostly from Suva and surrounding environ and are mostly from the Provinces of Kubuna supported ably by Tovata provinces.

    Thirdly what the public and the whole of Fiji do not realize that this is an attempt to cut down the influence of Rev. Ratabacaca; to close that door in the Prime Minister's Office that is normally opened to him by the PM himself on behalf of the nation.

    The calculating initiator, perpetrator and manipulator does not want Rev. Ratabacaca to continue to have this opportunity, hence the attempt to clode that door opened to him because this clique group wants the PM to listen only to them...

    Who else in Fiji would want this advisory and counseling role to PM JVB all to themselves in the present illegal Government's decision making process?

    Who else but the Puppeteer herself, Nashat Shameem, her puppet illegal AG Aihaz Sayed Khaiyum and their Muslim Clique Group.

    JVB: you are trying to determine who the root cause of all this is; just look closer to home and rationalise why.

    BY NOW U SHOULD BE AWARE THAT REV. RATABACACA WAS NEVER IN FIJI ON THE DAYS / DATES ALLEGED IN THE REPORTED COMPLAINT.

  67. I do ot agree with Anonymous 11.45 am. It is best that we get to know Aiyaz Sayed Khaiyum's real roots for only through can we be able to understand him better.

    So AZK is an illegitimate son of Prem (of MH Nausori and an Accountant...but which of the 5 Accountants...or maybe all of them with a touch of Fijian I Taukei chromozome to put a spanner in the works)...maybe this is why AZK has a depraved personality...a calculatingly accountant and clerically thieving personality...
