Beddoes: second meeting with Ghai cancelled because of blackout

That's the message from the president of the United Peoples Party, Mick Beddoes, to the illegal leader, Frank Bainimarama.
 
Beddoes says Bainimarama's almost daily denunciation and threats against people making submissions to the Constitution Commission and his attack on the Chair, Yash Ghai, is in clear breach of
Decree 57 of 2012 and in particular Section 7 (1) a, b, c, d, e, f, g, h and Sec 11 (1)  General Provisions.
 
He says if Bainimarama keeps it up, he will undermine the entire process and wipe out any credibility his Commissioners have managed to achieve so far.

Bainimarama revealed his anger this week that Ghai was making time for his enemies, NGO's and political parties and had even met privately with some of them.
 
He said: "That is the problem that we have here. He (Ghai) is pressured by these NGOs and politicians. These are the same group of people that want to have a hand in the composition of the Constituent Assembly so that they can pressure him into doing this and to changing what they want done and in the Constituent Assembly, have it cemented before they move into elections.”
 
He referred to the situation as so: “What is happening is like a proverbial camel.  They come in with their head into the tent and then their whole body comes in and they kick the owner of the tent out. That’s what him and the people they are listening to are trying to do. They are trying to get us back, bring back the old statements that they have been going on with for the last couple of months." 

 
Beddoes has confirmed he and his political colleagues met with the ‘full commission’ saying a second meeting was planned but had to be postponed because of the FEA blackout. 
 
He says the meeting was by appointment and at his reqeust, not the Commission's. And he says they were grateful Ghai and the Commissioners were willing to meet with  them, just as he hoped they would be willing to meet with anyone else who might need to.
 
Beddoes says Sec 7 (1) (f) (ii) of Decree 57 permits meetings in private and if Bainimarama keeps up his attacks on submitters, than he will not be surprised if people start opting for private and written submissions to avoid being the subject of personal and malicious attacks, 'courtesy of Fiji’s compromised Media industry, just for presenting an alternative thought to the process'.
 
He says the current attitude on display from the regime reminds him of a famous speech made by Sir Winston Churchill to the American people on Oct 16 1938:
 
"'People say, many people, we ought not to allow ourselves to be drawn into a theatrical antagonism between Nazism & Democracy? But the antagonism is here!  NOW!
 
"You see these Dictators standing on their pedal stools surrounded by the bayonets of their soldiers and the truncheons of their police!   They are afraid of words and thoughts, words spoken abroad and thoughts stirring at home, all the more powerful because they are forbidden.
 
These terrify them, a little mouse; a tiny little mouse of thought appears in the room and even the mightiest potentate is thrown into panic.’"
 
Beddoes says a little more humility, respect and trust in the people, the Commissioners and the process might be a 'worthwhile investment' for the regime at this time.
 
Earlier this week, Suva lawyer and the son of the FLP party leader, Rajendra Chaudhry, also tackled Bainimarama's determined efforts to have control.
 
“I think that it is about time Bainimarama also decides whether he wants to be a politician or an Army Commander. He cannot do both because there is a very clear conflict of interest and the Public Service Regulations address this. So why is there special exception for this man.”
 
He also questioned why Bainimarama is making comments about the submissions, rubbishing those those that he doesn't like. Chaudhry says Bainimarama is bullying the process and trying to control the outcome of the talks.
 
Chaudhry also urged the Commission to disregard the non-negotiable principles stipulated by the regime saying it should take the view of the majority of the people.
 
“It should not be influenced in any manner, shape or form by anybody, least of all by the Interim Prime Minister Mr Bainimarama who is obviously an interested party in the proceedings of the Constitution Commission and they are making comments on submissions by other political parties or NGOs. That is not proper for him to do. Let the people express their views, let the commission record those views.”
 
Bainimarama has told media he has been both Prime Minister and Army Commander in the last six years because of circumstances saying: "I’m going to be the Commander RFMF and Prime Minister for the next two years until elections and unfortunately for him and his father there is nothing they can do to change that.”

FIJI Constitution Commission chairman Professor Yash Ghai believes that the government should not scrutinise or criticise submissions made by people in the constitution consultation process.

Prof Ghai told The Fiji Times yesterday that the process was transparent and an open one.

"This is a free process," he said.

"The Constitution Commission is an independent body and is here to listen to the people of Fiji.

"This is the process where we encourage people of all ethnicity, class and community to come forward and make their views known to us."

Prof Ghai said the commission was mandated to listen to all who make submissions to them and they would take every submission made to the commission seriously.

"This is why we are here — to listen to the people," he said. "We encourage everyone from all ethnic background to come forward and make submissions," he said.

He said those who could not appear before the commission and make a submission could send in their submissions through e-mail, by post or hand-deliver it to them.

Prof Ghai said Fijians of Indian descent as well as Rotumans, Banabans, Chinese and other communities who were Fijians and the iTaukei members should come forward and make their views known.

Permanent secretary for Information, Sharon Smith-Johns said, "We do not want to comment, because we will distract the process.

"I think people need to shut up," she said. "Professor Yash Ghai has been making these statements from the beginning," said Ms Smith-Johns.

Every individual, NGO,political party or religious group in Fiji should have a right to say whatever he or she wants before the commission whether it is racist or political in nature. It is up to the learned commissioners to decide what is best and should finally go in the most important document of the land. The views could be published in the media but there should not be any running commentaries on any of the views. All people in the world are different and have different point of view.

I have a feeling Ghai is silently regretting accepting the job he is doing now with the latest attack on him by the bufoon. Ghai accepted the job hastily without checking whether the mandate that led to his getting the job was credible. All and sundry know the mandate never came from the people but from the gun-totting goons unlike the 1997 constitution the formulation of which was mandated by parliament, the representativew of the peoplke. This means the current process has no legal legitimacy unless it was commissioned by the people through a democratically assembled parliament. Which means the 1997 constitution is alive and well as supported by the 2009 Appeals Court judgement.

If the Prime Minister knows that he has taken over the reign of govt. to do things which is in the best interest of all the Fijians, and he firmly beliefs that majority of the Fijians agree with him, why have this consultation process anyway? Just get those top people in govt. (including PM, AG and Land Force Commander) and draft a new constitution. After all what goes in this document will be in the best interest of all Fijians. It will save a lot of time and taxpayers money.

Why should political leaders meet secretly with Yash Ghai?

They, of all people, carry more weight then individuals and so more reason that their submissions be in camera and in public. What do they have to fear?

So now that the 'precedent ' of private meetings with the Commission has been set, will the official FLP and SVT Party submissions also be held in private. Will every other party and his dog be allowed to present in private. What the heck, everybody can meet the Commissioners in private, clear the room, time for a cup of tea and chit chat.

Makes a mockery of all the individuals and groups who have the guts to face the public with their submissions.

Once more and again, the "elite" leaders in society don’t need the public or their thoughts and opinions. They are above the rest and the political process. No need for them to wait in line with the common, unwashed people.

Commission Chairman Yash Ghai undertook to post all submissions on line, and stated clearly that anyone who did not want to have their submission posted on line would have to indicate so. Also each petitioner was to be given 10 minutes.

I ask the Commissioners, are they going to post submissions on line or not? and if so, when? Will it be after the hearings or any time soon?

We now have a situation where people can meet the Commissioners in private and choose not to have their submissions posted on line. Total secrecy, five commissioners and one draft Constitution.

If political parties do this, then how are voters ever going to know what they stand for?

If this is an exercise in democracy, I need to go back to school, I missed something.

Let us not forget that Ghai has to come up with a 'constitution that complies with a couple of decrees (immunity etc) Khaiyum has written. So, to none surprise some conflicts emerge. But hey, we all know what we are going to see when the talkfest is over: Immunity for murder, treason, theft and human rights violations and a clear mandate for the RFMF to rule us forever.

There is way out of this: Frank could plead insanity and be pardoned for his deeds. Instead of going to Naboro he could stay in Suva where the St Giles Clinic specializes in cases like his.

Why use Washington to support your scheming and damaging submission that is designed to support you and you alone. Why didn’t you make a comment when you asked about the SDL submission? Are you trying to cover from the media and the public that you do support the SDL submission? Why arrange for a close door meeting with commission when you have always advocated transparency and accountability. Are you trying to outmaneuver the other political parties and place them and everybody else in a position of disadvantage and destroy them when the time is right so that you may win the election? We want transparency, transparency and transparency and we also want accountability, accountability and accountability. No fraudulent and corrupt dealing although they are synonymous with your name.

Please come clean and do not quote some prominent figure to legitimize your cunning and selfish scheme. Remember George Washington was also cynical and distrustful of politicians like you which he clearly stated in his farewell speech on September 19, 1796, quote:

Ian Simpson, this is not an exercise in democracy, at least as far as the regime is concerned. It's simply a stall tactic and an attempt to set the stage for a regime-controlled 'constitutional' process designed to hand Frank the keys to the kingdom.

The question is just how far Yash Ghai will let the regime continue to try to stage-manage everything. He must appreciate by now how Bainimarama operates. Normally submissions should be public, but in case you haven't noticed yet, we're operating under a dictatorship here, where going public can get you beaten or firebombed by Bainimarama's roving goon squad.

However, Yes it is a fact that we are under a dictatorship. But we cannot plant a seed of fear on people. We need to build courage as at the end of the day it is the people who is going to end the misery in this country. If we admit to the fact that it is a dictatorship and fear them, then we do not have an option than to agree even with the non negotiable conditions in the constitution. We have to oppose with facts with the commission. We need to corner them such a way, the commission and the regime have to think about their next move...these moves can be very important as far the donor countries are concerned.

Why, because it allows all citizens to have an equal say in the decisions that affect their lives. For example it promotes equal participation in the formulation of our constitution.

If Dakuwaqa lacks wisdom, why is it that his analysis is usually proven to be spot on?

I think most people would like submissions to be public so that we know what's being said and by whom. On the other hand, if at least some are private then Yash Ghai and his crew can hear a greater range of more honest opinion.

Candor is important, because truth is the enemy of this regime, as it clearly recognises. Sure, it would be better if candid submissions were public, but it's not as if Fiji's media would dare publicise them even if they were.

If the choice is between submissions being public or being candid, then I'd say candid. But better they were both.

You mention the FBI training the police in Fiji. The Australian Police Force are in Fiji 3-4 times a year training the Fiji Police.

I commend Australia for sticking to their guns. Bainimarama is still a dictator. The Human Rights abuses continue, The rule of law has ceased, the army is still in control with their guns. The only thing that has changed is Frank supports which ever country gives him money. That happens to be China at the moment and so China has more influence. But next year it might be Taiwan or Russia or …..

Australia on the other hand has shown great loyalty to the people of Fiji. It continues to donate money, it continues to support the tourism industry. When times are tough they are the first with their aid and their help. And they don’t even get a thank you from an ungrateful dictator

State = people. If you have some understanding about Fijian culture, you should know the separation of church and people is like separating blood from the vain. Some may call it immaturity of religion. In any case the the religion is attached to everything in life with Fijians. On the other hand any religion (from the ones I know of) teaches about politics, good governance etc etc. This is not a question about religion being part of people. This is a question about how people manipulate these ideologies to their advantage. Fiji for fijians, Christianity and other indigenous rights should be the focus of discussion. Once these issues are sorted then, only then we can talk about beautiful words such as "multi racial, secular state etc"....It has to be a progressive approach. One cannot kill the institutions and ideologies and get people to adopt the new. If any institution/ideology has to die, then it should die a natural death.

Methodist church leaders should declare loyalty only to Christ and have FAITH only in HIM and follow his example of HOLINES which does not include ongoing yaqona drinking which symbolises worship of the Vanua.
