Qarase's sentencing judge asks for police protection

The Suva High Court judge that handed down a prison sentence of one year to Fiji's last democratically elected prime minister has been given fulltime police protection.
Justice Priyantha Fernando requested a protection detail for himself, telling police he would need it until he felt secure. 
As of today, an intelligence officer from the Southern Intelligence Bureau has been assigned to stay with the Sri Lankan judge  whenever he is in public. A police officer is also now based at his Nailuva Road house. 
Fernando sentenced 71 year old Laisenia Qarase to a year's imprisonment last Friday, upholding a guilty verdict on nine corruption related charges by three assessors.
The SDL leader who denied the charges is, meanwhile, returning to the High court this Wednesday for another case. 
Qarase and two others from the Fiji Native Land Trust Board (former general manager Kalivati Bakani, and former director Keni Dakuidreketi) are expected to enter a plea on charges of abuse of office.

Qarase faces two counts, Bakani one count and Bakani and Dakuidreketi four counts of fraudulent conversion.

The case will be called for a mention of a plea to be taken and for any issues to be heard from the defence in relation to the consolidated information.

According to an earlier Fiji Live online report, at the previous court sitting disclosures had been served by Fiji’s Independent Commission Against Corruption prosecutors and the defence counsel had informed the court they sought further time to review all documents.

He must be equally scared of the Fiji Tamils - South Indians - whose co-brothers he has been holing down for centuries, which gave rise to the Tamil Tigers. I hope we Fijians have the same guts like the Tamil Tigers - these Sri Lankan judges would think twice to accept a position on the Fiji bench. Wakep up, Fijians, and make these scoundrels life a hell. Its good to know that he is a prisoner from his own decision to send our Prime Minister to prison. Why is he asking for police protection? This is an indication that the decision to send LQ wasn't his, he was ordered to deliver a guilty verdict. Bainivuaka and Aiyarse, people are not dumb. The judge was instructed to deliver what you two pigs wanted. This judge will eventually return to his native country and the enormity of the decision and the influence placed on him will haunt him. He will spill the beans, wait and see.

Asking for protection is also a sign that he thinks he did the wrong thing.

Presumably Nazhat Shameem is still writing it for the world to see - come on, you coward, call on the illegal regime to post your judgment on Paclii - the law website for the Pacific region - instead of calling on the dictator to provide you 24 hour protection

A new Justice of Appeal for the Supreme Court was sworn in this morning by Acting President and Chief Justice Anthony Gates. In taking her oath Judge Chandra Ekanayake said she would sincerely and solemnly bare true allegiance to the Republic of Fiji according to law. Judge Ekanayake was admitted to the Bar in 1974, was appointed as a Judge of the Primary Court in 1979 to 1980, was a High Court Judge in charge of general control of the Administration of the High Court of the Western Province in Colombo in 2001 and In 2003 was appointed as a Judge of the Court of Appeal of Sri Lanka and was later elevated as a Judge of the Supreme Court in 2008.

Did the Judge ask for protection detail or was it simply provided by the regime since the latter is in a better position to make that assessment on security issues that may potentially arise from the Qarase case.

the deal as a Director of FHL? No!!

Guess what, Siti was employed by Vinod Patel as soon
as this regime kicked him out of FHL?? Fishy??? He

These should be investigated if the law applies equally

If we compare the crimes and the specific of what was committed, as againts the sentencing of the former PM of Fiji Mr Laisenia Qarase and Francis Kean, the brother in law of the current PM, one can deduce that corruption and nepotism is rife and at its maximum in Fiji at the momement.
And if the current judiciary thinks otherwise, then the techniques they are using to manage cases brought up for their scrutiny are self explanatory to all stakeholders.
Remember the regime initially took over an elected democratic government, because they alleged that the former government was rife with corruption and nepotisim...hello, it looks like this military regime is more corrupted than any former government elected by the people combined. Are you guys guilty, or are your consciouss telling you that this is all wrong!!! I think that if your conscious are indicating otherwise, then you guys needs to be checked at Saint Giles..
The curent saga with the imprisionment of the former PM of Fiji induces that Fiji indeed has a Kangaroo judiciary poisioned with malice and kila vata! If a convicted killer like Francis Kean is not only freed and pardoned, but also appointed into a key Fiji Public Service designation, and someone like Mr Qarase who was deliberately caught up by the web of administrative policies of Fijian Holdings...remember neither he, nor his croonies stole a single cent. They were merely scapegoats and were at the cross roads of political bickering.
The judge is seeking extra protection because of guilt and the consiousness of making a very big mistake, hence undermining his credibility and reputation which will now be tarnished forever. Sorry Judge, the world knows that you are cheap, incompetent and unprofessional.
Please go back to Sri Lanka ASAP because you will not be leaving a normal forever. This also goes to those FICAC lawyers, crown witnesses including Weleilakeba and wanna be Timoci Vesikula, who spent most of his life in the UK, and now spoiling the reputation of Verata and tearing up the Tailevu with his Northland conspiracy theory..what positives have you brought to Tailevu anyway...shame!! please go back to UK and rot there...we do not need you here in Fiji.

It seems that everyone in this regime is seeking security protection from the people they claim to lead.
Look at the amount of protection given to the PM, AG, CJ, the Ministers, Judges, etc..etc., something is not right.

It is because the people running the system are not elected/selected by the people, they forced their way in, and are scared they'll be forced out.

history: afta 87 coups, govt under rambo, gave $$ thru FDB for i-taukei development. Qarase was md @ fdb – the $$ was provided for the purposes of encouraging i-taukei get into ‘business’. Waililakeba (secretary of FDL) and qarase worked together – converting some of the shares into his own name, son, wife and Q-ten. This $$ were soft loans to the provinical councils, so they could buy shares in FHL, and the dividends would be their operating income.
Q used his position to convert what should have gone to the i-taukei for himself/family. the loans were then converted to grants and the grants were made irrecovable and written off, by Qarase thru FDB accounts.
The humilation in jail playing marbles with his mate george speight will live in his mind forever. what was sweet then is now very bitter. q wont be able to stand for elections in 2014. end of the road for him. dont forget Q rang howard to ask him to raid fiji!!!
if frank had not taken over in dec 2006, fiji would now have no money in FNPF, govt would be a puppet of Aust n NZ, mining coys, world bank, IMF, asian bank, etc and their would have been blood shed between the two major races in fiji as the cronies would create diversions so that no one would look at them.
he took what belonged to the i-taukei for himself. the qoilqoli bill, and release of the 2000 coup perpertrators would have walked free – including some chiefs, but they were “used’ by others and race problems was the main thrust. George had sold the mahogny stocks to an american coy for less than half-its value and wanted the coy to deposit $$ into his bank acct in Aust, but he got caught too and did the coup in 2000. Qarase was made PM, by Frank, who later removed him.
One can fool some people, but they cant fool everyone all of the time. The sentence is very lenient.
the printed matter in Fiji is much to be desired – there were/are no problems between the major races but all the hype by the then editor of Fiji Times (FT which should be turned into a mesuem of hate provocation), Vijendra kumar, supported the TAUKEI movement, Rambo, and all the others and now wants to stir up the race relations issues again. that is why Frank kicked those journos out – as they were inciting racial hatred.
please remember qarase stole from his own i-taukei – nothing to do with indians taking the vanua. live together like sister and brother.

I think Judge Priyantha Fernando should have police protection. he had no hand in guilty verdict - that was by the assessors. cant blame them if tupou was lousy in her defence of qarase. Fernando could have suspended the sentence but chose not to do so as it would have meant a one way ticket to Sri Lanka.

In my opinion you seem to be on the ball with your comments and that.. but..can you please put something tangible on the table so we the silent masses in Fiji can lock on to. It is my opinion that there should be term limit for the PM. It should be 2 four year terms. Also that Fiji should be declared to be a Hindu state and everyone in Fiji should made to follow the religion. This is in light of SDL's submission. At least SDL will than understand how the rest of Fiji community feel. Oh yes I forgot to mention that Hinduism is the oldest living religion. We in Fiji will make history by taking this step. This in particular since India it self is not a Hindu State.

By the way, I am an i Taukei and not a supporter of racist SDL or Qarase. May he rot @ Korovou.

Part One of Two

In my last posting, I began to lay out a proposal for changing Fiji through collective, nonviolent action. I referred to it as Operation Jericho. I asked for your commitment of two minutes to change Fiji for the better -- the first minute devoted to quiet prayer and reflection, the second minute to stepping out in faith, courage, and action.
I intentionally gave few details about the plan, but I did give the date, time, and place. D-Day is 26 September. M-Minute is precisely 7:00 p.m. The place is in and near downtown Suva.
Why 26 September? The intervening weeks will give us enough time to publicise our plan. It will also give secretly loyal elements within the RFMF and Fiji Police time to develop their own follow-on plans to build on Operation Jericho. Also, on 26 September, Bainimarama will likely be preparing to depart Fiji for the United Nations General Assembly in New York. If Operation Jericho is successful, the only choices open to the dictator will be either to leave the country at a time of particular regime insecurity or to acknowledge that insecurity by canceling his departure. Even if Operation Jericho falls short of its goals, the approach of M-Minute will complicate regime planning.
I understand from confidential sources that Fiji Police monitor Coup 4.5 and are already reacting to my vague announcement of Operation Jericho by laying provisional plans to have extra police on patrol in downtown Suva on 26 September. That's fine. Indeed, the more, the merrier. The extra police presence can do little to impair our operational effectiveness. I welcome them to witness the beginning of the end for the regime and draw the appropriate conclusions.

Why 7 p.m.? At this time, most people are off-work. If they work in downtown Suva, chances are that their shift ends at 5 or 6 p.m., in which case we're only asking that they stick around a while longer to help ensure Operation Jericho's success. If they're still working, they can participate in their workplace or, if need be, slip away for only a minute. This is a shopping hour in Suva, at which time the streets are still fairly busy. Again, the more, the merrier. The sun will set at 6:05 p.m. that evening. The cloak of darkness will add to the effectiveness of the operation.

Why Suva? It's the seat of power -- the regime, the military and the police. It's host to resident diplomatic missions. It's important commercially. Its population is concentrated. And instead of dissipating our efforts over a broader area, our focus on Suva frees those in outlying provinces to come to Suva to participate in Operation Jericho.

So what does this collective, nonviolent action called Operation Jericho entail?

As some of you might have guessed from the name 'Operation Jericho', I'm proposing a noise barrage, a tactic used successfully by other democracy movements.

You must allow Scripture to intepret itself ( ie see what the WHOLE Bible say about a subject matter)
You cannot just pull out a verse and then say this is what the Bible says.

Did you know that there is even a verse in the Bible that says "..There is no God.."

May be this is the problem with the church in Fiji. They are lost singing choruses and no one is studying their Bible anymore.

One thing you conveniently forgot in your list above is that God is a God of JUSTICE.

Many times in the Bible God wants us to deliver Justice.
Jesus died on the cross because God's JUSTICE needed to be met.

We are even supposed to stand up for those who cannot stand up for themselves.
Bainimarama needs to be subjected to JUSTICE.

Hear what God says :

I am a sri lankan living and working in Fiji and know that the Judge is doing his job . He is a fair man and has conducted the case fairly in my opinion . He doesnt need outside help to write his judgements .
@ lawyer , 6th Aug -shameem couldnt have written his judgement as she was away in Europe working on an ICC assignment , I found out recently .So stop speculating lies .
During '87 , Fiji had sri lankan judges and they did the same and served the judicairy when your neighbours turned their backs on Fiji . Sri lankan s are hard working people and are here to help Fiji come back to normality .
Dont disgrace them . Its sicking to see the venonmous comments .

These Judges may be highly professional people but because they are under this kind regime the mixed perception is always ther. Another major high court trial is coming up in the next few months for former Prime Minister, Laisenia Qarase who is currently serving a one year prison sentence.

Qarase is charged with two counts of abuse of office.

It is alleged that on the 18th of December, 2003, Qarase while being employed as the Prime Minister, Minister for Fijian Affairs and Chairman of Native Land Trust Board caused the extinct mataqali funds amounting to 3.4 million dollars to be transferred as capital for Vanua Development Corporation which was an act prejudicial to the rights of the Fijian Affairs Board and the indigenous Fijians.

According to the charges, the funds were required to be paid to the FAB.

It is also alleged that on the 12th of March, 2004, Qarase, in abuse of the authority of his office for the purpose of gain facilitated the awarding of the MYSAP Information Technology contract to Pacific Connex Limited without adhering to proper procedures.

The charge states that the alleged act was prejudicial to the rights of the NLTB and the indigenous Fijians.

In this case former NLTB General Manager, Kalivati Bakani and former NLTB director and Chairman of Vanua Development Corporation, Keni Dakuidreketi will be tried with Qarase.

Bakani is charged with one count of abuse of office.

It is alleged that as General Manager of NLTB, he facilitated the awarding of the MYSAP Information Technology contract to Pacific Connex Limited without adhering to proper procedures.

Bakani is jointly charged with Dakuidreketi.

They are facing four counts each of fraudulent conversion.

It is alleged that on the 24th of June, 2004 and 14th of July, 2004, Bakani and Dakuidreketi fraudulently applied by effecting the payment of 2 million dollars which consisted of extinct mataqali funds as a loan to Pacific Connex Limited.

According to the charges both were directors of Pacific Connex.

It is alleged that Bakani and Dakuidreketi again fraudulently applied by effecting the payment of 900 thousand dollars of the extinct mataqali funds as a loan to Pacific Connex Limited between the 18th and 19th of November, 2004.

It is alleged that they did the same between the 28th and 29th of September, 2005 with an amount totalling 1 million dollars from the extinct mataqali funds.

It is also alleged that between 27th April, 2005 and 3rd July, 2007 Dakuidreketi and Bakani fraudulently applied a government grant of 1 million dollars which was disbursed to Vanua Development Corporation through the NLTB as security for a loan by Pacific Connex Limited which was a purpose other than the purpose of the said government grant.

Today High Court Judge, Justice Priyantha Fernando revealed that he will not hear the case.

He said he has already asked that another judge be nominated to preside over the case as he has already heard Qarase's earlier case.

Upon questioning by Bakani's counsel, Aseri Vakaloloma on who will be the judge, Justice Fernando said that is not the lawyers concern.

Qarase was escorted to court by officers from the Fiji Correctional Services.

The case is adjourned to 14th November for the pre-trial conference as the lawyers want further discussions on the proposed agreed facts in the case.

Qarase's new lawyer in this case is Tupou Draunidalo.

His previous legal counsel was Qoriniasi Bale.

Dakuidreketi is represented by Queens counsels Brian Keene and Maria Cole.

Bakani is represented by Filimoni Vosarogo however Vakaloloma appeared on his behalf today.

Qarase in court for different fraud charges

Convicted former Prime Minister Laisenia Qarase appeared in court this morning for fraud charges along with former senior i-taukei Land Trust Board executives Keni Dakuidreketi and Kalivati Bakani.

Qarase is currently serving time for abuse of office and discharge of duty.
For this case – Qarase is charged with seven counts of fraudulent conversion along with Bakani.

Bakani and Dakuidreketi are charged with two counts of fraudulent conversion, one count of conspiracy to defraud, and one count of abuse of office.

They are alleged to have defrauded the i-Taukei Land Trust Board while they were executive board members.

High court judge Priyantha Fernando says all parties need to be ready with the agreed facts by November 14 – for the pre-trial conference.

Justice Fernando could not confirm whether he will still be the trial judge for this case.

We now live in a Cash economy, Christian values and under parliamentary democracy. Ownership of the Qoliqoli has to change likewise.Qarase was not providing the leadership to lead Taukeis into the future but was simply playing to the mindset of Taukeis too lazy to make mental changes to suit the times we live in now and in future.

The I qoliqoli remained the property of the Itaukeis ever since they set foot on this islands. Who gave it to the crown and then to the state currently? Queen Victoria (British Government) gave this concession of a fishing right to the indegeniuos for their sustenance, otherwise other british subjects might deny them access.
This concession was given, for their sustenance, but not their exclusive right. They were made responsible for management as they had experince in conservation, already practiced by them.
Now itaukei want fishing rights but no responsibilty for conservation. If u cant practice conservation management, you dont deserve any fishing right. You are abusing your privilage.

NO, nobody has any right to abuse our natural resources.

The point is, the SDL solution through the Qoliqoli Bill is too simplistic for a complex set of factors. The proposal through the Qoliqoli Bill to make other citizens pay for the use of coastal resources is potentially antagonistic towards building a nation and is reminiscent of club warfare. SDL should go back with clear heads and soound minds without the yaqona mix and come up with a solution that would promote national unity rather than division and conflict.
