Sacked Sri Lankan chief registrar gathered dirt on Khaiyum

No rule of law: Arachchi said to have documents on regime dealings.
The sacking of the chief registrar, Ganga Irani Arachchi, doesn't end with her hasty departure from Fiji after less than three years in the job.

She may well cause more controversy for the regime after triggering an unprecedented number of judicial staffers to writer letters of complaint about her.


Word has it the Sri Lankan magistrate has compiled a list of documents and recorded conversations with the illegal attorney general, Aiyaz Sayed Khaiyum, where he was directing her to charge lawyers on complaints not supported by facts. 

Arachchi also has documents and memos by Khaiyum to show he authorised the hire of cars only from Central Rentals, a company his family has an interest in. 

Arachchi, whose contract was terminated on Saturday,  reportedly also has details of different pay scales for different judicial officers - records which show a huge disparity in what locals are being paid and what the Sri Lankans imports are getting.

In the case of magistrates, local magistrates are paid a whopping $38,000 less than their Sri Lankan colleagues.  For judges, the difference is $33,000.


According to figures obtained by Coupfourpointfive, that means local magistrates get $65,000 and judges $103,000 while Sri Lankan magistrates are pocketing more than $100,000 and judges more than $135,000.

Sri Lankan judicial officers also have life insurance and medical insurance paid for by the regime but locals get no such privilege in terms of life insurance.

Judicial sources say Arachchi was aware all along she was only a stop gap measure for the regime and did everything to protect herself just as Aca Rayawa did when he was DPP, copying written directives and recording or putting phone calls from Khaiyum on speaker phone so other senior prosecutors could hear the directives given to the DPP on who to charge and when to charge.

According to sources the illegal chief justice, Anthony Gates, isn’t too happy with the departure of Arachchi: they say he had personally recruited her with former high court judge, Nazhat Shameem, and is worried there could be a fallout to sending Arachchi packing.


Gates and Khaiyum turned to Sri Lanka after abrogating the Constitution in 2009 and sacking judiciary, and insiders say Gates fears it could turn other Sri Lankan magistrates off from coming to work in Fiji.
 
Sources say Arachchi also has copies of Court documents filed by the former President of the Court of Appeal, William Marshall, where he sued the Government for wrongful termination. 

Marshall's 844 page affidavit alludes to interference by Khaiyum – some by way of letters from judges like Inoke Sosefo (whose contract was this year not renewed by the regime) and Deepti Amaratunga. 

Arachchi accepted the documents as submitted by agents of Marshall for filing but did not release it back to them and gave no reason for why she was sitting on the documents. 


Insiders say on being told she was being sacked, she asked to serve her notice period out and made copies of all sensitive documents and had them delivered to a location in Nasese in Suva with instructions they be given to certain persons, including the diplomatic corps.

It is being suggested the documents are to be released during the final week of the Constitutional Commission's public sittings.

However, sources say Arachchi’s fate in Sri Lanka is set  to be unpleasant with the former judges and magistrates she sacked all apparently alerted to her return and fall from grace.

It is common knowledge that the military council had agreed that Khaiyum was to be booted out. Yet he still remains. Ask Colonel Inia Seruiratu, permanent secretary for Regional Development, he is known to have told a concerned fellow RKS Old Boy about this. He is one who feels strongly that Khaiyum should be kicked out. They are becoming restless with the way indigenous institutions are being dismantled by Khaiyum. We can all understand where they are coming from because they themselves are i Taukeis. They did not expect that the reforms of indigenous institutions would go to such an extent.

Look at it, the accused is sitting whilst his QC is on the left, on the right is the translator who is explaining the details of the charges in the Fijian language to the accused who does not really understand English. Behind the accused is the prosecutor who has handed the accused over to be tried. The list of Bainimarama / Khaiyum supporters is good but please let us put in the list only those who should be there. There are so many people in this Government who have been serving with all integrity and honesty persevering away for the people of Fiji.

Some have chosen to remain on for one reason; with the country at heart knowing that they can serve better rather having their positions being taken by inexperienced unproductive wanabees if these positions were vacated willingly.

Let us remember these hard working civil servants who have given their lives to serving Fiji and its people. REMEMBER THAT SOME OF THEM HAVE BEEN REMOVED PREMATURELY AND ILLEGALLY BECAUSE THEY HAD CONTINUED TO SERVE DILIGENTLY WITH INTEGRITY DOING THE RIGHT THINGS AND DOING THINGS RIGHT, NOT SUCCUMBING TO BAINIMARAMA'S WHIMFUL DECISIONS, REFUSINF TO BE YES-MEN TO THIS GOVERNMENT WANNABEE LEADERS.

Chaudhry and Maraiwai found guilty

Two Suva lawyers, Rajendra Chaudhry and Kini Maraiwai, have been found guilty by the Independent Legal Services Commission.

Commissioner Justice Paul Madigan said the one count of professional misconduct and one count of unsatisfactory conduct have been established against Rajendra Chaudhry and the two counts of unsatisfactory conduct and professional misconduct have been established against Maraiwai.

The first count of unsatisfactory professional conduct against Kini Maraiwai is in relation to Maraiwai preparing an affidavit of a Muskaan Balaggan and witnessing the document himself without having it witnessed by an independent legal practitioner or Commissioner of Oaths.

Balaggan swore an affidavit on the 4th of July last year that the allegations of rape and sexual abuse she had made against Rajendra Chaudhry on the 13th of June last year were untrue and she withdrew them.

Justice Madigan said the importance of not acting in the manner that Maraiwai did is brought to the fore when it later transpired that Balaggan made another statement signed before a Commissioner of Oaths which was a direct contradiction of the reasons given in the earlier affidavit.

The second count of unsatisfactory professional conduct deals with Maraiwai continuing to act for Balaggan who was charged for giving false information to a public officer on the basis of the affidavit which had been prepared and witnessed by Maraiwai.

The third count of professional misconduct is also established against Maraiwai.

This deals with Maraiwai failing to act in the best interest of his client Balaggan by instructing Rajendra Chaudhry to appear on the 15th of September 2011 for mitigation being aware that Chaudhry was the victim of the false complaint made by Balaggan and therefore was a conflict of interest.

Rajendra Chaudhry’s first charge relates to him agreeing to act as a counsel in Muskaan Balaggan’s court case from the 15th to 29th September last year.

This is a case in which Chaudhry was the victim of a charge of giving false information to a public servant.

Chaudhry’s next charge of unsatisfactory professional conduct relates to him showing discourtesy to the High Court, namely to Justice Daniel Goundar on or about the 15th of April 2012 in his response to an enquiry made by the Chief Registrar under the Legal Practitioners Decree.

The charge said such conduct is a breach of the Rules of Professional Conduct and Practice of the Legal Practitioners Decree 2009.

Justice Madigan said such assertions of impropriety, bias and vindictiveness against a judge are totally unacceptable apart from being unethical.

He said Rajendra Chaudhry has been in practice long enough to know that any decision, ruling or judgement of a judge is appealable and that his allegations could be aired on appeal, no doubt in more temperate and neutral terms.

The sentencing will be delivered on notice by Justice Madigan.

I don't know which is worse. Our media saying they don't practice self-censorship or that they don't have the fire in the belly that it takes to be reporting in Fiji today. Either way, looking at the news in our media, which is th best judge of hat is and what is not happening in Fiji, our journalists are not doing such a great job.

Four media organizations have so far confirmed that there is no self censorship in their newsrooms despite claims made by certain individuals in interviews and forums.

We contacted the Fiji Times today and Editor Fred Wesley said they are not self censoring.

When questioned by Fijivillage, Wesley said journalists are not afraid or reluctant as claimed by people from outside the newsroom.

Fiji Broadcasting Corporation’s Manager News Indra Singh also said there is no self censorship.

Communications Fiji Limited which runs Legend FM, FM96, Viti FM, Navtarang, Radio Sargam and fijivillage.com stresses that there is no self censorship by its journalists and no one including USP’s Journalism Head Marc Edge has ever spoken to our journalists about this matter.

Edge has claimed in media interviews and forums that there is self censorship in the Fiji media.

When asked, he confirmed that he has not conducted any surveys in relation to this.

Fiji Sun Publisher Peter Lomas said there is no self censorship in Fiji Sun and anyone who reads the newspaper will know this.

Lomas said the journalists are not afraid.

He said no one from the Fiji Sun newsroom has heard from Marc Edge.

Lomas said Edge seems to be rather remote from the daily news media.

He also said Edge never spoke to one of the Sun’s Deputy Editors who was part of a panel in the recent Media Symposium at USP.

We have contacted Fiji TV Editor Geoffrey Smith and he has referred all queries to Fiji TV CEO Tarun Patel.

We are now awaiting a reply from Patel.

The question to ask is Did the government buy out the remainder of the contract for Ganga Irani Arachchi? If so that this is getting to be very expensive for the government. Last year a bunch of magistrates were either forced to resign or resigned at their own accord. When you breach a contract the is a plenty. Also if Fiji keeps breaking employment contracts, we will have a very bad reputation with the International community. Soon the contracts will not be worth the paper that the contract is written on.

Two Suva lawyers, Rajendra Chaudhry and Kini Maraiwai, have been found guilty by the Independent Legal Services Commission.

Commissioner Justice Paul Madigan said the one count of professional misconduct and one count of unsatisfactory conduct have been established against Rajendra Chaudhry and the two counts of unsatisfactory conduct and professional misconduct have been established against Maraiwai.

The first count of unsatisfactory professional conduct against Kini Maraiwai is in relation to Maraiwai preparing an affidavit of a Muskaan Balaggan and witnessing the document himself without having it witnessed by an independent legal practitioner or Commissioner of Oaths.

Balaggan swore an affidavit on the 4th of July last year that the allegations of rape and sexual abuse she had made against Rajendra Chaudhry on the 13th of June last year were untrue and she withdrew them.

Justice Madigan said the importance of not acting in the manner that Maraiwai did is brought to the fore when it later transpired that Balaggan made another statement signed before a Commissioner of Oaths which was a direct contradiction of the reasons given in the earlier affidavit.

The second count of unsatisfactory professional conduct deals with Maraiwai continuing to act for Balaggan who was charged for giving false information to a public officer on the basis of the affidavit which had been prepared and witnessed by Maraiwai.

The third count of professional misconduct is also established against Maraiwai.

This deals with Maraiwai failing to act in the best interest of his client Balaggan by instructing Rajendra Chaudhry to appear on the 15th of September 2011 for mitigation being aware that Chaudhry was the victim of the false complaint made by Balaggan and therefore was a conflict of interest.

Rajendra Chaudhry’s first charge relates to him agreeing to act as a counsel in Muskaan Balaggan’s court case from the 15th to 29th September last year.

This is a case in which Chaudhry was the victim of a charge of giving false information to a public servant.

Chaudhry’s next charge of unsatisfactory professional conduct relates to him showing discourtesy to the High Court, namely to Justice Daniel Goundar on or about the 15th of April 2012 in his response to an enquiry made by the Chief Registrar under the Legal Practitioners Decree.

The charge said such conduct is a breach of the Rules of Professional Conduct and Practice of the Legal Practitioners Decree 2009.

Justice Madigan said such assertions of impropriety, bias and vindictiveness against a judge are totally unacceptable apart from being unethical.

He said Rajendra Chaudhry has been in practice long enough to know that any decision, ruling or judgement of a judge is appealable and that his allegations could be aired on appeal, no doubt in more temperate and neutral terms.

The sentencing will be delivered on notice by Justice Madigan.

What is the difference between Kaiviti, Kaipalagi and Kaiindia?.

ANS. There is no difference. All of them are belong to human race. Kaiviti's drifted to Fiji from Africa, Kaipalagi's came as traders from Europe and and Kaiindians came as indentured labourers. All three are immigrants to fiji. Why then so much hate, animosity and antifeelings amongst each other? Let us all live togther peacefully, respect each other, help each other and live in harmony with each other. Long live multiracial fiji where our children will have better standard of living. Fighting and bickering will take us no where. Look at the Middle Eastern countries, eg Iraq,Syria,Yemen, etc. God bless fiji and our children.

A former National Federation Party parliamentarian, Sayed Khaiyum, said Fiji should be a secular state.

While presenting his submission to the Constitution Commission at the Suva Civic Centre, Khaiyum added that the state needs to stay neutral in the matter of religion and no religion should be funded by the government.

He said every religion must be protected, however, adequate control be placed on the establishment or places of worship.

Khaiyum said some form of restriction should be placed on those currently located in the residential areas against noise nuisance.

He said a present trend of worship has been springing up everywhere and anywhere without control which is a result of total failure and laxity on the part of our own municipalities.

Khaiyum also submitted that parliament should only have one house which should be the House of Representatives with only 50 members elected on the principal of one man, one vote, one value.

He said that 50 seats should be divided between four constituencies and the term of parliamentarians should be of four years.

He said while the voting age should be 18 years, voting should not be made compulsory which it had been before, however, was a total failure in terms of policing and penalizing.

He said the position of the country’s president should be retained, however, the Vice President’s position should be made redundant.

He said the president should be elected by the people for five years and not appointed by any one person.

Khaiyum said any person who has taken residency in another country and has been away for 5 years or more should not be eligible for appointment to any decision making position in the government, should not be allowed to contest for a seat in the House of Representatives or be appointed or involved in any state matters or civil service.

Khaiyum said that all citizens of Fiji should be called Fijians irrespective of their ethnicity, however, the indigenous population of Fiji may be classified as I-taukei to distinguish them from other Fijian communities for special purposes.

He also said that there should no longer be a ministry of I-Taukei Affairs as it is not necessary to maintain a ministry for any ethnic group.

He said the functions of I-Taukei Affairs which is primarily rural focused, should be given to the Ministry of Provincial and Rural Development.

It is important that their names are published so that they must be put on the record for supporting a corrupt and murderers regime.

There are also some villagers in Fiji that openly declared their support for the murderers regime.

Kaihum now do not have normal family life which will greater repercussion on her wife and daughter and his parents and family. They are now living inside their own prison they created.

There are many differences and I beg to differe with Khaihum senior.

Fijians were orinally called Kai Viti by those outside Fiji especially the Tongans, Samoans, and other Pacific neighbors.

But the Tongans political influence in the early days and their access to new religions played a significant role from Viti to Fisi. The explorers began to translate it from Fisi to Fijian in British English.

I am question why change the name?

I must warned all in advance that the word I taukei was not part of the Fijian name prior to the time when Ratu Sukuna began his land reform for the F8ijian people. The word i taukeihas a very strong nationalist connotation which intensionally tries to separate the Kai Viti from the late commers or Non i Taukei.

I understand that people wish to called Fijians but the they have lost the value, history and the whole spiritual identity behind the name especially their traditional tie to the Vanua.

To Kaihum and Sons you may have been successful in pushing for a common name but the real owners of the name will always have the potential to regain their inheritance, their name.

Can you imagine for some one from Tonga or Samoa to be called Indians in India just because they have migrated there. NO PACIFIC ISLANDERS WILL EVER CHANGE THEIR NAME TO ANOTHER NATIONALITY.

The reasons....only these people can explain this to them.

Most Pacific Islanders are in Australia and New Zealsnd ....pls Kaihum Senior and family ..tell me what do they call themselves Australians/Kiwis etc

You may say yes....in their hearts they still call themselves Tongans, Fijians, Samoans etc.

The name is not a superficial thing but something inherited by blood through wars, etc and that is why when we play rugby it is war to us and for you guys when you play soccer it is just purely entertainment.

I know the boys at QEB are getting restless seeing Fijian institutions being shaken to the ground. The regime top guns are well aware of the underlying danger that could explode anytime. The onll that is saving them from being subjected to this danger is the national coffers. Each time the regime inner circle intelligence feel there is danger, they inform Bai and Bai being Minister Finance quickly dishes out a pay rise. The boys in green are having a good time with the palm greasing they getting which is the most single factor that is stopping them from acting but how long is this going to continue. Fiji is a Bi-cultural society NOT a multicultural society. Australia is a multicultural society and US and Canada-these states were originally settler colonies. Fiji was never a settler colony. They tried for example to introduce new disease to wipe out half of the kaiviti and make it a settler colony.

Thank God for our Qase ni Lotu for their faith in our Christian God.


My point is that No outsider must not tell us how we live and practice our culture. It seems that every Tom, Dick and Harry are criticizing our culture and tradition and our social system.
