Key Fiji political parties back proposed Constitution

Political Parties unanimously endorse Draft 2012 Constitution
In a joint statement issued today, the main political parties in Fiji, the SDL, FLP and UPP have unanimously endorsed the Draft 2012 Constitution.

The statement said that the Parties having perused a copy of the draft constitution and supporting documents presented to the President by the Chair of the Constitution Commission Prof Yash Ghai, were satisfied that the people’s views and submissions had been fairly reflected in the document.

While there may be some areas of concern on a small number of issues, on balance the party leaders felt it was a constitution they could work with.


The draft constitution provides a sound basis for the governance of the nation based on the universal principles of respect for and the protection and promotion of human rights.


Particularly commendable is an extensive and comprehensive Bill of Rights section which protects the individual freedoms and rights of all citizens including a special focus on the rights of children and the elderly, the Party Leaders said.

The draft constitution has a number of other innovative features which address issues of significant concern to the people of Fiji. Checks and balances have been put in place to curb abuse of office and to ensure good governance through measures which require full accountability and transparency in the formulation of government policies and administrative practices.  It also spells out a Code of Conduct for the holders of high public office.

The recommendation for the establishment of various independent Commissions such as the Ethics and Integrity Commission, the Constitutional Offices Commission and the Police and Corrections Commission, are designed to stamp out corruption and abuse of office.      

While media freedom and freedom of expression is guaranteed and protected, the draft constitution emphasizes the need for a responsible and accountable media and requires Parliament to establish an independent regulatory body to oversee standards and monitor compliance.  

The Leaders said the document recognized and guaranteed the trade union rights of workers and places strong emphasis on the welfare of the deprived in society.

The Great Council of Chiefs has been recognised as an advisory body on   i-Taukei affairs and a custodian of i-Taukei culture and traditions.


he creation of a National Consultative Land Forum is welcomed as it will focus primarily on reconciling the divergent interests of the landowners and tenants for their social and economic advancement as well as that of the nation as a whole.

 The peoples’ right to education, economic participation and an adequate standard of living is emphasised in the draft constitution requiring the State to take reasonable measures for the progressive realization of these goals.

The chapter on Justice and the Rule of Law is comprehensive with due emphasis placed on the absolute independence, impartiality and competence of the judiciary. Access to the Courts is unrestricted giving people freedom to initiate court proceedings if they feel any law, act or omission is contrary to the Constitution.

A welcome feature on the preservation of laws is one that voids the provision in any decree promulgated by the regime that ousts the jurisdiction of the courts or tribunal, as of the date that decree was made.

The regime has issued a number of decrees that either restrict or totally remove the peoples’ right of access to the courts. These decrees are made null and void under the draft constitution.      


The Leaders express their thanks and gratitude to Professor Yash Ghai and his commissioners and staff for a commendable job done under extremely difficult circumstances.

They apologise to Professor Yash Ghai for the personal abuse and degrading treatment he was subjected to over the confiscation of 600 printed copies of the draft constitution and the burning of various copies in front of him.

The Leaders denounce such barbaric and shameful behavior by the security forces, typical of the misguided few who cling to power without the legitimate consent or mandate of the people of Fiji. Such acts do not reflect the normal behavior of the good people of Fiji.

Leaders deplore the secrecy that surrounds the draft constitution. They call on the regime to immediately release it for public discussion and debate within their own organisations and communities as it is a peoples’ document.

It is to be noted that the public consultation process on the draft constitution provided for under Decree 57 was rescinded by Decree 64 issued on 31 October 2012.

The people of Fiji have every right to know what is in the draft constitution before it goes to the Constituent Assembly for debate.

Meanwhile, the Leaders call on the security forces to desist from issuing intimidatory statements on the draft constitution.

  1. I am very much opposed to the provisions granting military personnel immunity from prosecution for crimes against Fiji and citizens.

    But under the circumstances I agree that we should accept most of the Draft Const.

    We should then work towards eliminating the Fiji military

  2. If the RFMF doesn't like the Draft Constitution that is sufficient reason for me to like it. But keep the draft on ice. first we need to sought out the issue of the illegal trashing of the lawful constitution of Fiji. we need to set things right by following proper legal and lawful process. then the draft can be the basis for a "constitutional reform".
    anything before that means accepting the legitimacy of the illegal Bainimarama regime.
    Another thing I want to know why anybody needs to go to australia for corporate governance or any other kind of training ? I thought the RFMF had all kinds of experts - including lawyers who can even teach law professors about the law!!

  6. EGG on the face to all those who initially rubbished Prof Ghai including the above political parties. Now they are accepting it. The Police was right in burning the 599 copies of constitutio. Ghai's job was to write a constitution and present it to the council. Why was he printing 599 other draft copies. For example in the external examination students get the final copy of the exam not the draft copy. I know this blog will not be published

    If the RFMF had already pre-determined what Must be incorporated in the new constitution why go through all the bullshit about an "independent" constitution commission preparing a new constitution after "public consultations"? Why not just prepare an RFMF constitution and impose it - just as it has been doing via decrees since the 5/12/2006 takeover? Why all the lying and pretending?.

SDL/FLP/and others wanted to retain The 1987 constitution before.From the begining they were saying that military will not make a fair constitution, etc. Now a fair draft constitution has been drafted and presented to The President they have changed the tune and accepted it with open arms. Now again they are blamming Military for burning 599 draft constitution. What military is doing to Fiji is trying to steer fiji towards modernism, set the process correctly for future, bring about real democracy, erradicate nationalism and racism, set parameters for future growth, harmony and prosperity. Bainimara government is to be applaued for the very good work. The losers, the nationalists and the racists who complain on this blog about indians, Bainimara, etc. are to be blamed. In 1987, 2000, They were very happy supporting governments who were marginalising other races. To them before pointing fingers at others point at yourself and find where the problem is.     So i am ready to face the real democratic court not Khaiyum court .
    So my advise dont talk too much komai or boci people with no guts using fijian name.
    Fijian need to stand up and fight for democracy.
    I have tried but people are too scared to stand up for truth and justice.
    So now i will do how much i can but battle have to be won with peoples support .no man can win by himself.
    Media in Fiji have become more as regime supporters.

    I have my freedom of speech and democracy in NZ.I feel for my family and friends in Fiji

There was 500acres freehold land known as Navatu Estate located near to Malau Jetty,this land was bought by National Farmers Union to settle displaced farmers,this land should have been under NFU name as their money was used .Reliable sources say that this paicular land has been transferred to Mahendra Choudhrys wifes name???? We think it was a bit mischievous for the SDL to drag in Ratu J Kubuabola to put his name of the flimsy partition, knowing full well that his brother Foreign Affairs Minister is one of the few hard working members of the Bainimarama/Aiyuz Cabinet and may have been awkward to for both brothers during family Christmas together! Yet SDL claim to up hold “veivakaturagataki” and all other itaukei cultural virtues.
    How about other high profile SDL Politician like the Marama Bale Roko Tui Dreketi. Even if the Marama Bale is overseas there are ways to attest her signature. How about senior Fijian Indian member s of the SDL hierarchy?
    Or are we now led to be weary of SDL’s new “ divide and rule” tactic, dividing families, dividing the Vanua, dividing the Christian family, wrenching away the few non- itaukei supporters from their traditional political comfort zone…etc…etc…is i SDL now rudderless with the absence of her leader?
    They batter hurry up and put their act together as 18 months to election is not long time in any political campaign time line…should those discrepancies fixed asap, then we may still vote SDL!

We think it was a bit mischievous for the SDL to drag in Ratu J Kubuabola to put his name of the flimsy petition, knowing full well that his brother Foreign Affairs Minister is one of the few hard working members of the Bainimarama/Aiyuz Cabinet and may have been awkward to for both brothers during family Christmas together! Yet SDL claim to up hold “veivakaturagataki” and all other itaukei cultural virtues.

    How about other high profile SDL Politician like the Marama Bale Roko Tui Dreketi. Even if the Marama Bale is overseas there are ways to attest her signature. How about senior Fijian Indian member s of the SDL hierarchy?

    Or are we now led to be weary of SDL’s new “ divide and rule” tactic, dividing families, dividing the Vanua, dividing the Christian family, wrenching away the few non- itaukei supporters from their traditional political comfort zone…etc…etc…is i SDL now rudderless with the absence of her leader?

    They better hurry up and put their act together as 18 months to election is not long time in any political campaign time line…should those discrepancies fixed asap, then we may still vote SDL!

  67. This is actually a potentially important political development. It appears to mean that Fiji's main political parties have set aside their serious misgivings regarding the illegal and even treasonous way that the Ghai draft comstitution came to be and are even willing to let Ghai's draft supplant Fiji's lawful Constitution.

    Why would they choose to do this knowing the draft's unlawfulness and unsavory provisions for amnesty covering the treasonous acts committed in the period 2000 to the present?

    I believe they chose to do so because they understand that the military regime has already begun to revise Ghai's draft in ways that aim to water down its human rights and accountability provisions, in favour of a new version that will enshrine an interventionist political role for the military. So, the parties are calling Frank's bluff. By accepting the Ghai draft as written, they are trying to make it unnecessary, and hopefully therefore more difficult, for the regime to come up with its own, even more distasteful version.

    Were Bainimarama sincere he would at this point welcome this endorsement, invite the same parties to participate in the Constituent Assembly, encourage early ratification, declare victory, and return to the barracks. But of course he is instead a lying, cheating scoundrel. So I'm guessing he'll ignore the endorsement, pack the CA with his most sycophantic supporters, and then have it adopt a new Nazhat Shameem-drafted version that will keep him at the centre of power for many years to come.

    The SDL, Labour and United People's Parties have issued a statement accepting the document, printed copies of which were confiscated by Police recently.

    Fiji Labour Party leader Mahendra Chaudhry, speaking on behalf of the three parties, says they are very concerned that the draft constitution could still be drastically altered by the constituent assembly, but as it is it is a document that provides a reasonable future for Fiji.

    HILL: Well you've actually come out, all three of these main political parties, and said that you support this draft constitution that the Constitution Commission has actually produced. It's kind of unusual for three quite different political parties to agree on something like this isn't it?

    CHAUDHRY: Well it may be but we've been having this problem with coups for the last 25 years and in this period of time we have changed the constitution three times, this will be our fourth constitution. Having had a look at the contents of this constitution, while everybody may not have got what they wanted or what they would have liked, on balance I think it's a document which we can work with, which can be improved if need be once we have parliament in place. But I think it's a very comprehensive document and on all aspects of governance, including human rights, bill of rights and the rule of law, economic management, accountability, transparency, I think it's a very well thought out document and if it is given full effect, I'm sure Fiji will rid itself of a lot of problems that we've been facing in the last 25 years or so.

    1. Here Meo gives us a preview of what the regime's approach will be to the endorsement of Ghai's draft by the three leading parties. It will pretend, as Meo does, that the parties no longer enjoy popular support and therefore should be ignored. Of course, no evidence exists to support this notion, and Ghai's draft was written after wide consultation with more than just these parties, but that will likely be the regime's new line.

      Meo wishes for new parties to supplant the old, and probably thinks he should lead one himself, as if he could be elected dog-catcher. He pines for a "post-modern vision" for Fiji, but what he really offers is the same post-moral vision that now chokes Fiji, which would give traitors amnesty and continued usurpation of power under the cloak of an unfree and unfair election.

    The Qorvis-controlled Fiji Sun has taken the offensive against the draft - giving Tikoitoga valuable newspaper space to discredit Yash Ghai and offer the RFMF's alternative Constitution. Why don't the political parties, because they are undoubtedly finding great difficulty in penetrating the local media's "No Local Politics" news zone, post their own amendments to Yash Ghai's draft on this blogsite.
    That, at least, will provide an opportunity for some real debate on the draft Constitution to begin BEFORE the Bainimarama-selected Constituent Assembly begin their own charade of "debating" the draft when in fact all they'll be doing is amending it to include Nazhat Shameem, Aiyarse Khaiyum and Tony Gates' versions?

    Before the end of last week, Fiji was making good progress toward the elections coup leader Voreqe Bainimarama has promised for 2014. Draconian emergency regulations that suppressed free speech and political debate had been lifted and a draft constitution had been drawn up.

    However, there are now fresh signs that the destructive coup culture that has held Fiji back for more than 20 years is alive and well.

    The police seizure and later destruction of 600 copies of the draft constitution strongly suggests the military is unwilling to submit to rules that make clear soldiers belong in their barracks, not the seat of government.

    The armed forces' submission to the constitution commission claimed the military was ''the last bastion for law and order in Fiji'', and demanded it be protected as it was in the constitution created by original coup leader Sitiveni Rabuka in 1990. That gave the military ''overall responsibility'' for the security, defence and wellbeing of Fijians.

    The commission's draft takes a very different view. Although it agrees the military's role is to protect Fiji from external threats, the explanatory note emphasises it does not have any role as a ''guardian of the constitution or conscience of the nation''. Furthermore, it says the military should be under civilian control exercised through a democratically-elected parliament.

    In other words, the people of Fiji will tell the military what to do, not the other way around.

    The draft also contained continued immunity for Mr Rabuka and Commodore Bainimarama, but only if they swear an oath to accept the sovereignty of the people. That would include submitting to ''democracy and the rule of law'', something neither has displayed much appetite for in the past.

    It is difficult to escape the impression that the police seized the 600 copies of the draft and burnt them - obviously with the blessing, if not the complicity, of the military - because Commodore Bainimarama is not prepared to accept that the people of Fiji, not he and his armed cronies, are the masters of the nation's destiny.

    If so, it would be a great pity. There was growing hope that Commodore Bainimarama, who had previously reneged on a promise to hold elections in 2009, was this time genuine about restoring democracy and returning the military to its rightful station.

    So encouraging were developments that New Zealand, which contributed $500,000 toward the constitution commission's work, is preparing to dispatch a high commissioner to Suva for the first time since 2007.

    Fiji Land Forces Commander Colonel Mosese Tikoitoga justified the seizure and destruction of the draft copies on the grounds the commission's head, Kenyan academic Yash Ghai, had made them illegally. Colonel Tikoitoga said the military decree that authorised the commission's work allowed it only to supply its draft to President Epeli Nailatikau, as it did last month.

    Unfortunately, Fiji's history of coups gives ample cause to suspect the military's real motive was to prevent the Fijian people from discovering the status proposed for the armed forces.

    PRIME Minister Commodore Voreqe Bainimarama has outlined that 2013 will be the year Fiji will set scene for one of the most momentous events in the country's history - the 2014 elections under a new constitution.

    In his New Years message Commodore Bainimarama appealed to all Fijians to contribute positively to the elections process.

    "We should have a new, modern constitution by the end of the first quarter of 2013," he said. Commodore Bainimarama said by the end of 2012 about half a million Fijians have registered by electronic means to cast their vote in 2014.

    "As 2013 begins, that process continues as we reach out to register Fijians living abroad," Commodore Bainimarama said.

    He said the New Year heralded great promises for all Fijians.

    "Its time to reflect on the year that has passed and to contemplate what the future holds for ourselves and our families," Commodore Bainimarama said.

    He said Fiji's economy was comparatively buoyant and a steady growth has been forecasted.

    "We are investing more in the education of our young people to help secure their futures and increase the country's skill base.

    Commodore Bainimarama said as a nation the government wants to instil more pride in the identity of Fijians.

    He also highlighted various leadership roles bestowed upon Fiji by the international communities last year.

    "These are great honours bestowed on us by the international community and we should all be proud because the honour belongs to all of us."

    Commodore Bainimarama said this was the time when many people made new year's resolutions and urged Fijians to make some for the nation. "Let's be considerate of our fellow citizens and honest in our dealings with each other."

    Draft constitution copies in safe hands

    599 copies of the draft constitution printed by Constitution Commission chairman Yash Ghai are in the safe hands of the Fiji Police Force.
    This was confirmed to the Fiji Sun yesterday by the Commissioner of Police, Brigadier-General Ioane Naivalurua.
    “I can confirm to you that the 599 copies of the draft constitution are in Totogo in the safe hands of the Police,” the Police Commissioner said.
    Brigadier-General Naivalurua said Police had to intervene to secure Government property.

    He confirmed no copies were burned despite claims by Professor Ghai.

    The Police Commissioner said the copies with them now would be given to members of the Constituent Assembly when the President decides to do so.
    Meanwhile the Republic of Fiji Military Forces (RFMF) Land Force Commander, Colonel Mosese Tikoitoga said the Police were tipped off and confiscated all the printed copies.
    He said the Constitution Commission decree clearly states that the Constitution Commission was to gather information from the people, write the draft constitution and present the draft constitution to the President.
    “The President will give it to the Constituent Assembly, who will, through the chairman of the Assembly, print them and then distribute them to the Constituent Assembly for discussion by the constituents,” he said.
    “The Police confiscated the printed copies and they’re now in Police custody. They were not shredded, nor were they burned as Professor Ghai claimed on Australian radio.”

    1. Here Meo gives us a preview of what the regime's approach will be to the endorsement of Ghai's draft by the three leading parties. It will pretend, as Meo does, that the parties no longer enjoy popular support and therefore should be ignored. Of course, no evidence exists to support this notion, and Ghai's draft was written after wide consultation with more than just these parties, but that will likely be the regime's new line.

      Meo wishes for new parties to supplant the old, and probably thinks he should lead one himself, as if he could be elected dog-catcher. He pines for a "post-modern vision" for Fiji, but what he really offers is the same post-moral vision that now chokes Fiji, which would give traitors amnesty and continued usurpation of power under the cloak of an unfree and unfair election.

  148. Our old pal Dakuwaqa advised Yash Ghai to bail sooner than later, as "the regime has a strong tendency to punish its friends". Ghai instead unwisely chose to stay on and now frankly looks a bit foolish and ill-used.

    Dakuwaqa predicted that the regime's next step would be to cherry-pick those reforms it wants and discard those it dislikes. This process already seems to have begun. The neanderthal Tikoitoga is the front man, but expect Nazhat Shameem to run tightly controlled meetings of the so-called Constituent Assembly to railroad through the military's favoured measures.

    This highly contrived process has no legitimacy whatsoever beyond that modicum lent it the other day by the major political parties. Similarly, ratification by an unelected, treasonous assembly hand-picked by the regime gives it no legitimacy, either.

    A free and fair national referendum requiring a super majority to pass is the clearest ratification method by which this document can be legitimised ex post facto. The regime will never allow that so long as the reins of government are in the smarmy hands of a thug whose primary motive is to escape arrest and prosecution for his numerous high crimes.
