Fiji's 'Coalition' trio out of the Constituent Assembly


Powerful trio: sidelined and opting out of the Constituent Assembly
The leader of the United Peoples Party, Mick Beddoes, says he would be showing acquiescence to the regime to have put his name forward for the Constituent Assembly.

Beddoes told Coupfourpointfive he was in touch via fax with the Permanent Secretary to the illegal prime minister's office, Pio Tikoduadua, on December the 31st following a meeting of the UFDF but he has yet to hear back from Tikoduadua.

"The United Peoples Party letter sought some clarification on a few concerns, which have still not been made known by the regime. I did say that once it clarified the issues we raised, the UPP would consider our participation. It's been a few days since then and we've had a public holiday in that time as well, so I'll give Pio time to respond. If they don't come back, then the UPP will not participate."



Tikoduadua told FBC yesterday more than 100 people had shown an interest in being on the Assembly. He is today being quoted in the Fiji Times as saying it's more than 300.

SDL, the Fiji Labour Party and the United People's Party have been working as an informal Coalition and represent a very strong power base and challenge to the unelected government.

But with the SDL leader, Laisenia Qarase in jail and FLP leader, Mahendra Chaudhry facing charges under the  Exchange Control Act, it has been largely left to Beddoes and the UPP to step up.



Beddoes says with the recent controversial events regarding the Constitution process, there was no way his party could be involved in the Constituent Assembly. 

"While we were prepared to and did participate fully with the process despite it being entirely set up by the regime, the regime's conduct during was anything but open, free and fair and people who submitted things that they did not like, were at the receiving end of abuse and threats from Frank Bainimarama on an ongoing basis.

"We were obviously not happy with the regime's decision not to allow the period of time for the people to view the draft, after all this is the people's Constitution, not Frank Bainimarama's private property. And the international community funded this process, not the regime.

"But in the end, the net result was a draft Constitution that in the main we considered fair and one that took account of what the people were saying. We each had some areas of concern, but on the whole we considered it a Constitution we could all work with."

Beddoes says the confiscation of the 600 copies printed by the Constitution Commission and 'the deplorable attempt to intimidate and scare Professor Yash Ghai with the burning of 3 shredded proof copies in front of him and his staff and employees of the printers' was not a surprise.

"Thankfully, Professor Ghai is not someone who scares easily."

Beddoes says the regime's actions since then has been a wake up call.

"Next they set loose the Land Force Commander, whose role it seems is to try and discredit Professor Ghai, and start the intimidation process of the members to be appointed to the Constituent Assembly so that the regime's secret Constitution or amendments can be brought in and changes made to the draft to then reflect their demands.

"With the intent of the regime to threaten and intimidate their way through to the end clearly re-enforced by their actions against their own Commission Chair and the commission members they appointed, and their decision to now 'ignore the people' and try and keep the draft constitution secret, it's not difficult, to see what their real intentions are for the Constituent Assembly. 

"I hope for Fiji's sake I am wrong, but based on their performance so far, it's clear they are working in their best interests and not the interests of the people of Fiji!"

"Knowing all of this, I am unwilling to submit my name to the very person who committed the worse crime possible against the people and the state and to give him, the perpetrator of our oppression, the privilege to decide on my eligibility or otherwise to sit in the Constituent Assembly to consider a new constitution for Fiji."

Editor's Note: A statement from the Fiji Labour Party says the current charges against Mahendra Chaudhry do not stop him from being on the Constituent Assembly.

It says he was cleared of nine of the '12 trumped up charges' laid against him and that 'the remaining three charges refer to the Exchange Control Act of which he was cleared by an independent inquiry in 2008.'

"There is, therefore, no reason why he cannot sit in the Constituent Assembly. There is no conviction against him. And under the law, he is presumed innocent until the charges are proved."


It says it wrote to Pio Tikoduadua on December 27 seeking information on the composition of the Constituent Assembly prior to deciding whether to participate. 


"We have not to date received a response to our letter. The FLP’s position on the Constituent Assembly is that its composition must be transparent and fair, and give full cognizance to the elected representatives of the people."

Why not these old political pensioners or "Fiji Government in exile" (if there is one who should have been ready to take over) or these prodemocracy guru, draft its own constitution, then give/sent copies to members of the Assembly..

Don’t you think that that may then justify the final product be the document ALL of us collectively ordain? Why not, as now we have about 3 different versions of the draft floating around. ..may be the more the merrier?

Beddoes if you dont want to be in the constituent assembly why make a big fuss. Initially you were not supporting the good Professor Ghai and the constitutional process but now you are saying the draft constitution is good. In 2006 the same Mahen Chaudhry was against Qarase and fully supported the Army in taking over the government. This is all hyporicsy. Make a stand.

The problem is Mr.Meo the constitution is the document that suppose to promote democracy but this regime and you are trying to be an island on its own and I think they tried to do that to Ghai but they accidentally shot themselves in the foot when Ghai went to the media and the whole world found out what the real intention of the regime was. Bai cannot isolate himself he is playing with the big boys and the ball is in his court and he needs to show evidence of a democratic process being undertaken and it seems the ice berg is starting to show its bottom.....

The Chairman of Fiji’s Constitution Commission, Professor Yash Ghai had breached the Constitutional Process Decree by trying to reprint and distribute the draft constitution.

This is according to RFMF Land Forces Commander Colonel Mosese Tikoitoga who said Professor Ghai abused his appointment in this breaching process.

Tikoitoga said Professor Ghai’s role was not the consultation process but was to receive all the information and write the draft whereby the consultation would be done by the Constituent Assembly, which will later be assembled to debate on and inform the public.

He added it was not in his detailed task to do yet he went ahead and did it.

Fijivillage raised the issue with Colonel Tikoitoga, on whether Ghai’s actions were one of transparency.

I don't know what the new "Fiji" will look like when everything is dictated by the dictator. He seems to have the ultimate say on what the people should accept without the mandate or consent of the people whose throats he shoves his plans down. Let the people decide for themselves what is good and what they want and not by someone else whose has huge vested interest in the outcome of the elections. Beddoes speaks a lot of sense and makes a stand on principles. Lets put it to the people and see what they really want. Keep to the elections timeline and have a free and fair one and have overseas monitors.

The Land Force Commander is so involved in this constitution thing that he is forgetting his main responsibility to protect Fiji against outside interference. Is it any wonder that when the Tongan Navy came marauding into Fijian territory, we were caught flat footed and could not do anything about it, but just let a big fish escape?

These failed Fijian soldiers should just let the people decide on how to pass their constitution and not harass them because they are not the enemy. How prepared are they if real terrorists start targetting the people and infrastructure within our boarders? What will they do when they fail to protect the interests of other sovereign nations in the land?

What a waste of our resources when we are paying these hoodlums to do one thing while they are biting the hands that feed them.

The regime's desire to keep the Fijian public from having access to the original draft 'constitution' produced by the Ghai Commission calls to mind the saying that where it is a duty to worship the sun, it is pretty sure to be a crime to examine the laws of heat.

I can't believe it, given the labeling of the Fiji Sun as a regime mouthpiece newspaper by pro-democracy opponents of the regime, that the Fiji Sun has actually published a letter to the editor that questions the Fiji Military Forces intention to retain hegemonic control beyond 2014 when elections are to be held and a democratic government is formed.
In his letter 'RFMF Submission' (FS 4/1) Amenatave Malani writes the RFMF's "stated long-term objectives beyond 2014 is worrying" because in his view "the elected government of 2014 must be allowed to lead the country in accordance with its manifesto without any outside interference".
I couldn't agree more.
That is the way it should be in a democracy.
The RFMF seems to have some difficulty in understanding how a democracy works - even with all its imperfections.
It works a whole lot better then a military dictatorship.
That's why people are asking for a return to democracy.
Why isn't the military getting it?
What is the military's agenda?
The people of Fiji have a legitimate right to know what their military is about? Is it (the RFMF) there for them - the people of Fiji ?Or, is it there for themselves?

But he must first convince his senior party members like Praveen Bala and Chandu Umaria to resign from military appointments. meanwhile, Col Tikoitinga told Fiji Times last night that 2014 Sep Elections are now in doubt since the Consitution draft is not acceptable to RFMF. He told his favorate reporter that RFMF is looking at recommending 2014 Elections be cancelled and a new roadmap be announced to 2020 so that all pending strategic works will be completed and certain political leaders drop out of the scene by 2020.

No word on exact date of Constituent Assembly formation

There’s still no word on the names of people to be part of the Constituent Assembly – just days away from the Decreed deadline for the body to start deliberating on the draft Constitution.

Under the Fiji Constitutional Process Decree 58 of 2012, the Assembly is required to start debate on the draft by the second week of January 2013.

When contacted today – Permanent Secretary to the Prime Minister’s Office Pio Tikoduadua said his office is still collating the names of applicants keen to become members of the Constituent Assembly.

Tikoduadua says, the names will be made public once finalized and he’s urging the public not to worry about the ongoing public debate on the provisions of the draft Constitution.

There was a little penguin that loved to slide down the icebergs and do flips, one day he asked his parents if he could go do a couple of flips before dinner and they said okay but be back soon. The penguin went out to the icebergs and saw the biggest slide he had ever seen so he ended up staying there for hours doing flips off of the slide when he looks back and notices the iceberg has broken off and his home is miles away. So he thinks that's okay he'll just do flips all day. After awhile he gets lonely and one day he sees another iceberg in the distance and he gets really excited because then he would have a friend. The iceberg gets closer and he realizes that there's a girl penguin on the iceberg so he straightens his bowtie and starts thinking about what he's going to say to this girl penguin. Finally the icebergs collide and he runs over to the girl penguin and yells 'RADIO RADIO'

Just read in the Fiji times that a humpback whale that was trapped in a lagoon in Totoya Fiji for over 10 weeks has finally found freedom(FT 5/1)).
It's been described as great news.And, it is too.
The people of Fiji are still trapped in a dictatorship after 6 years and have still to regain their freedom.
It would be great news when that finally happens.

Mahen criticised the 1990 constitution but fully participated in the election. He was against the 1997 constitution but now wants the 1997 constitution back. He was against Professor Ghai and his team but now supports the draft constitution. In 2006 he was against Qarase and joined the military government knowing anytake over is illegal. Now he is against the army and supports Qarase. In my opinion he is the problem.

Constituent Assembly likely to be appointed next week

The Constituent Assembly which will deliberate on the draft constitution is most likely to be appointed sometime next week.

Permanent Secretary for the Prime Minister's office Pio Tikoduadua said the response has been overwhelming as they have received more than three hundred applications.

Tikoduadua said these applicants cover a wide range of representation of the community.

Tikoduadua said they are now in the process of collating.

THE now dissolved Constitution Commission had agreed that a draft constitution be leaked to a blog site.

This was confirmed by a member of the commission, Penny Moore, yesterday.

However, their actions have been labelled as “unbecoming” and “not expected” by the Republic of Fiji Military Forces Land Force Commander Lieutenant-Colonel Mosese Tikoitoga.

“They should be ashamed of themselves,” Lt-Col Tikoitoga said.

Ms Moore said the document on the blog site, together with the explanatory report and the statement by outgoing chairman Professor Yash Ghai, was the final draft document.

“The commission had agreed for the chairman to release (to the blog site) so people could view it,” she said.

“That was really the choice behind the decision.

“As far as we were concerned, our intention was to give them out to the President, a copy to the Prime Minister and his people, to the Solicitor-General because we do not want them to think we were doing things out of hand,” Ms Moore said.

“We were upfront with the process since day one,” she said.

Lt-Col Tikoitoga said their motives were clear that they wanted to destroy the process.

“It was unbecoming of them to leak the document given they have a high profile,” he said.

We all need to be "constructive" in our thinking in moving forward towards elections in 2014. Elections has to happen if it means accepting the "non negotiateable clauses". If the Constitution is not in place, 2014 election will not be a reality. Let's get the incoming Government in place and they be task with our Fiji.

A fair minded person will give credit where credit is due. And credit is certainly due to prof Ghai, the CC and even Penny Moore for they have shown "guts to stand up to Frank" the dictator. They could have taken the easy way out by simply producing the constitution Frank and his henchmen were DEMANDING. They didn't do that, did they? Infact by producing the constitution draft they have produced they have exposed the Fiji Military and its Commander Frank the usurper and self appointed PM for what they really are. They are people who have one agenda: to hang onto power by hook or by crook. They are people who have no abiding respect for democratic ideals of governance. We should be grateful to ghai and the Commission for coming out on the side of the people of Fiji rather then the Fiji Military. Over the past few weeks, the social sites that has Fiji followers have been inundated with stories of what is going on in Fiji under the current dicktator. Those that once followed him no longer understand what this man is on about and where he is taking Fiji.

We are aware there are several changes being effected namely, Fiji's constitutions a copy of draft conversation is inserted below; Fiji flag, Fijian Identity being robbed off Indigenous Fijians; plans to abolish Fijians registry of deaths & births which includes their Lands, seashores etc; other changes which are too many to list. Great Council of Chiefs, the cornerstone of Fijians existence has been abolished, any links with the Commonwealth is going to be wiped off i.e money where the Queen has her imprint will be replaced.

What is concerning are the facts that the diktator in Fiji is not consulting the people or allowing them to give their input to effect these changes. A case in point; is the Fiji's Draft Constitution which has been headed by Professor Yashi Ghai, an expert and a seasoned academic who is up to speed with these Constitutional changes and has been shafted by Fiji's regime and given the run for his money as he suffers the mal treatment of an evil diktator and his regime. The details of his being treated unfairly is inserted below for you to read and mull over.

We will be monitoring these changes and how Fiji people are being treated and not being given any opportunity to openly voice their views or concerns. As the case appears to be when these were done under the guidance of Prof. Ghai, we are told 600 copies of draft were burnt by Fiji police who are now denying this ever happened.

As we have always believed, in time to come we will know the truth to all this.

I gather from the news that Fiji's interim PM Frank Bainimarama said at the interim A-G's conference of some kind that a "handful of men should not be allowed to determine the Constitution" (FT 9/12).
How many men had put together the US Constitution? When was that Constitution made? Is the same Constitution still being used by the US? How has that been possible? Why has that been possible? What has the court's role been in upholding the constitution?
Why do we have constitutional experts if the constitution is everyone's cup of tea? Is the Fiji interim PM's constitution making notion just a form of mystification?

Ministry probes cheating cases

THE Ministry of Education yesterday revealed it investigated seven cases of malpractice or copying among students who sat for the Fiji Seventh Form Examination (FSFE) last year.

This comes in wake of the ministry's decision to award zero marks to 11 students of a Labasa school who were alleged to have cheated on their Biology exam.

However, the ministry did not say whether similar punishments were given in the other six cases.

In a statement yesterday, permanent secretary for Education Doctor Brij Lal said the ministry did not condone cheating — a fact conveyed to all schools before external exams.

"The standard procedure is when a student is found to have cheated or copied during the external examination, he or she will be disqualified," Dr Lal said.

OF COURSE STUDENTS WILL CHEAT WHEN THEY SEE THEIR LEADER, ILLEGAL PM,VUAKA, CHEATING.

I'm surprised only 11 students were caught.
It wouldn't surprise me if the whole bloody class cheated and probably the Supervisor was in on it too.

I know this coz most of my school friends who were in this category are now serving in Frank's army. If, in spite of applying, Beddoes and his allies are not chosen, that fact alone, would cast doubt on the integrity of the Assembly.
Now they're sitting on the sidelines like the rest of us. We therefore should not complain because we will deserve what we will get.
Saying they can work with Yash Ghai's draft, but making no effort to ensure the draft remains largely intact, does not make sense - politically or logically.
