Pictures of Fiji's draft Constitution being burnt

Information continues to conflict about just what happened but these are pictures from when police visited the Bluebird Printery and confiscated the copies the chairman, Yash Ghai, was printing for distribution.

They clearly show the distress of Ghai although the  second picture shows what sources say looks to be proofs set on fire as said by one of the other commissioners (Penny Moore) - not the drafts as said by Ghai.

A number of police were clearly on hand but there's no clear consensus on who sent them but knowing the way the regime works, the decision could've only come from the top, the illegal attorney, Aiyaz Sayed Khaiyum, down to police commissioner, Ioane Naivalurua.

Seven youths are in the custody of police in Savusavu for allegedly gang raping a teenager.

The men aged between 16 to 30 years are alleged to have raped a
16- year-old last Thursday.

According to police spokesperson, Ana Naisoro, one of the suspects took the teenager to a house where she was allegedly gang raped.

The teenager has been treated for injuries and is recovering at home.

Whether printed copies of the draft Constitution or only proofs of the draft were burnt is IRRELEVANT.
What is relevant is the fact that an atempt was made to DENY the people of Fiji their right to discuss the draft - BEFORE it goes to the Constituent Assembly - as provided for by the Constitution Decree (No.57)- AND - the amended Decree (No.64).
Legal experts can argue all they like about the legaility of Yash Ghai's releasing of the draft but in doing so they need to consider the following;

While the October 31, 2012 Constitution Amendment Decree (Decree No 64) attempted to "kill off" all public discussion of the draft BEFORE it reached the Constituent Assembly [Refer to Section 7 Amendments (j) and (k)], the amended Decree (No 64) FAILED to completely NULLIFY one important provision in the original Constitution Decree (Decree No. 57). The relevant section in Decree No 57 reads as follows: [“civic education” means programmes of education, whether conducted by governmental or nongovernmental bodies, having the aim of enabling the people of Fiji to understand the nature and
role of the Constitution and the guiding constitutional principles, and to participate effectively in the constitutional process].

This is further qualified by the following: [“constitutional process” means the entire process of constitution drafting and adoption, including the collection of public views by the Commission, preparation of a draft Constitution and public
consultation thereon, and decree of the new Constitution].

So, all that the amendment in Decree 64 did was cut out "the hearing of views on the draft Constitution". It DID NOT restrict, by Decree, Yash Ghai from providing the public with a document to which they could air their views (to whomever - not necessarily the Constitution Commission). It was clear from the intention behind both Decrees (57 and 64) that Yash Ghai was to present a COPY to the President. There was NO PROVISION, however, in either Decree RESTRICTING HIM from also presenting copies to the public to enable them to express their views as outlined in both Decrees. Admittedly the amended Decree intended to provide for "public discussions" AFTER presentation to the Constituent Assembly - however, the Decrees were not amended sufficiently to ensure this!!!
Yash Ghai is also justified in his actions as the provisions for his immunity in Decree 57 [14.—(1) A Commissioner, or the Executive Secretary shall not be liable for anything done or said or
in respect of any matter or thing said, or done or omitted to be done in good faith in that person’s capacity as
Commissioner or as Executive Secretary.] have not been amended. As explained by Yash Ghai his release of the draft to the public was done "in good faith" and followed a change (without due consultation) to the Decree which provided him his mandate.
So, in reality and despite what Tikoitoga would like us to believe, Yash Ghai did not act "outside his mandate" - he was well within his "mandate" to ensure that "civic education" was truly a part of the "constituional process".
The move, by police, to confiscate the extra copies was obviously in response to SOMEONE issuing an order "in bad faith" after realising that he had not sufficiently "plugged" all the loopholes!!!

I am pretty sure the police falas in the 3rd photo are impersonating the Fiji Police!
I am pretty sure a coup did not happen in Fiji on 5/12/2006 . only a "clean up" campaign was launched by the now "Honourable PM of Fiji"!

The documentary looks into the lives of the wives of some of the world's most notorious dictators. While their husbands torture and kill the wives live a life of luxury. The documentary maker likened most of these women to Shakespeare' Lady Macbeth. The revelation that a Fijian soldier serving in the British Army in the Parachute Regiment is now the orderly for Prince William and his wife, the Duchess of Cambridge Kate Middleton will no doubt make a lot of people proud.

The new recruit who cannot be named for security reasons is the couple’s first orderly.

We are told, the Fijian soldier — apart from his responsibilities of having to be the chauffeur, and arranging and planning of logistics of the man who is second in line to the throne — is also in charge of Prince William’s wardrobe.

The young Fijian soldier was seen driving the Duchess of Cambridge and Prince William on several official engagements. He has been described as a “lovely guy — like all army, a superb can-do attitude and great sense of humour”. We are told the Parachute Regiment to which the Fijian soldier belongs is an elite regiment in the British Army and is expected to provide or deploy an infantry force at short notice when needed.

The fact that the Fijian soldier has been given a very responsible job is indicative of the confidence the army has in him. It portrays confidence and reassurance in his abilities and is obviously a good sign for other Fijian soldiers who are willing to work hard to achieve their goals.

His achievement stands out as a major plus for every Fijian men and women who believe in their ability to do good at the highest level.

This is an apt example of what can be achieved with hard work, commitment, enthusiasm and passion.

Nothing is impossible. This is obviously a very proud moment for his family, his friends and members of his community and village. It is a proud moment for Fiji.

Our men and women have done well for the British armed forces.

The likes of the late Sergeant Talaiasi Labalaba and Takavesi, former members of the elite British Special Air Services stand out as heroes.

Then there is Derek Derenalagi for instance who was declared dead and was being put into a body bag when a medical staff noticed a weak pulse. He lost his legs in Afghanistan when the landrover he was on was hit by an improvised explosive device.

The rest is history for the man who went on to represent Britain at last year’s Paralympics in London.

Our men and women have played their part in maintaining a very strong link between our two countries.

Hundreds of young men and women have moved on to join the British Army and have served proudly in conflict zones in Iraq and Afghanistan.

More young men and women are still keen to join the British forces and to continue this historic link.

Today though, this achievement by our un-named Fijian soldier deserves attention. It is a worthy achievement and will go down in the annals of history telling the story of hundreds of Fijians who have been a part of the British Army. It stands as testimony of our capabilities.

Hard he not print other copies, Pro Ghai would have been a hero and would have the last laugh, now he is the subject of taunting laughter from the International Legal community for under estimating the ruthlessness of the Fiji Defence Force.

They're still trying to figure out how to reduce the numbers from 300 to one that they can afford. Otherwise, they fear they will lose control - as they did with Yash Ghai - if they were to seek foreign funding!!! They still have to find the funds to ensure Bainimarama keeps his promise to all those Cyclone Evans victims. He promised almost everyone he met that their houses would be re-built. Don't you guys watch the news. 60,000 people (population of the Navosa Province)have died in Syria in roughly one year fighting for democracy and freedom no body gives a rats ass about them. New Fiji Rugby Union High Performance manager Mike Ryan will be focusing on all forms of the game when he starts work at the end of the month.

Ryan comes with vast experience in HPU having worked with the likes of the Wellington Hurricanes in Super Rugby and the New Zealand Rugby Union.

Speaking exclusively to FBC Sports, Ryan says a team effort was needed to take the sport forward.

“Working with the people there who are currently involved there with Fiji rugby. To introduce a HPU culture into both men’s’ and women games and into fifteens and sevens and right across the whole rugby culture of Fiji.”

Ryan and the HPU will be responsible for the overall running of all codes within the union.

"This guy will eventually end up with a Fiji women and a decent property...just like all his predecessors" The said thing is that Fiji Rugby will again begin from zero development status.

The current management team just don't have the crucial competencies to dicern the trend....what a waste!!! Look at our current rankings in world rugby..That is the performance indicator guys.

In any modern state with civilized people, the process involved in the draft and its completion stage MUST be subject to public scrutiny. So what the commission did was absolutely correct. But the reaction from the regime is understandable because because they were,
a. bunch of unelected morons
b. protective of their own interests and agendas
c. very fearful of their future because of treason
d. people of no leadership integrity
e. were nothing but are now building their empire and making money for their families and cronies
f. failures in their profession and have tendencies to blame someone or a race or a group of people for their unfortunate under performance

The evil that dictatorships do always outweighs the good.
Infact history teaches us that in the long run no good comes out of a dictatorship. That's why there is a global movement towards democracy in the modern world. Fiji is currently out of step with this global trend.
Please read Ian Scott's book World Famous Dictators to obtain a better understanding of the way of the dictator.
The Introduction gives a good idea. It reads:

No newspaper in Fiji has reported on it. Some regime critics have maintained that the Ministry of Information in the Bainimarama Military Dictatorship and its Permanent Secretary operate like the Ministry of Propaganda in the old Stalinist Soviet State. Therefore much of what comes out of the Ministry they contend cannot be trusted. But the people of Fiji and the international community should know what is factually correct. Can an investigative journalist take up the challenge and get to the bottom of this matter and reveal the truth?
Why would a man of Professor Ghai's international standing as a constitution making expert need to lie about the burning of his draft constitution in Fiji?

The Australian government has welcomed the completion of Fiji's new draft constitution despite procedural differences between the chairman of the constitutional commission, Professor Yash Ghai and the government.

A spokeswoman for the Australian Department of Foreign Affairs and Trade said the draft constitution is a substantial document and another step along the path towards Fiji's return to democracy.

Meanwhile, the Constituent Assembly appointed by the Prime Minister is expected to be announced this week.

The Assembly will deliberate on the draft Document and their work is expected to be completed by late March.

Man to pay $50 for scratching ear while driving.

A MAN is refusing to pay a fine of $50 slapped on him by the Land Transport Authority (LTA) for scratching his ear while driving.

Rahul Gulab, 22, raised his frustration after he was booked for failing to control the steering wheel of his vehicle with both hands.

The employee of DHL was driving along Milverton Rd at Raiwaqa in Suva last month when he was stopped by an LTA officer.

According to Mr Gulab, the officer asked him why he was scratching his ear when he should be controlling the steering wheel with both hands.

After learning that Mr Gulab was an employee of DHL, a transport company, the LTA officer enquired if he was allowed to drive a company vehicle.



"How am I supposed to change the gear if scratching my ears is an offence?" Mr Gulab asked.

"I have never come across a driver fined for a similar offence," he said.

"After I answered all his questions, the officer laughed and said good luck for 2013," he claimed. Mr Gulab also claimed the officer's conduct was unprofessional.

However, LTA chief executive officer Naisa Tuinaceva said it was an offence when a driver failed to control the steering wheel with both hands.

He said any driver who wished to dispute LTA rules could take the matter to court.

"LTA has been transparent by giving offenders 28 days to settle their fine or take the matter to court," Mr Tuinaceva said.

That's a warning to Dharam Lingam...be careful, you might get fined too by the LTA for 'walking down the street with the finger up [your] arse'.

that's rather far fetched. prof ghai is a law professor and an international constitutional expert. he would know how to conduct himself.

There must be a huge shortfall in the national coffers that needs filling and a fifty dollar fine everytime a driver takes one hand off the steering wheel (including to change gears in manual cars) is an easy way to fill the financial void!!!

Then you see an LTA van up ahead and beside it, Mr Tuinaceva demonstrating to all who drive-by where drivers should have their hands at all times; then you realise that the drivers were just pulling up to scratch their ear or arse!!! A collection was bucket nearby ...

Former Opposition Leader & UPP President Mick Beddoes said all of the current ‘hoopla’ over the leaked document is self inflicted, but is being used by the regime as part of its ‘strategy’ to ‘discredit’ its own appointed Commission Chairman and certain members and with them the draft so as to justify the planned ‘amendments’ to it during the CA passage, so that all of the provisions that require them to become accountable or have their decisions subject to challenge in a court of law for example, can be removed.

Beddoes urged people to obtain copies of Decrees 58 & 64 of 2012 and see for themselves just how manipulative the Regime has been in trying to exclude the people in this final process.

Beddoes said the original decree No 58 [issued on July 18th 2012] always had as a part of the process an opportunity for the people to review the draft and make comment and this was in Sec 8 (1) (c) quote ‘debate the draft Constitution as well as the Explanatory Report of the Commission, and the views of the people of Fiji expressed on the draft Constitution’ unquote.

Also in Sec 8 (2) it says quote ‘When adopting the draft constitution, the Assembly shall consider appropriate and workable provisions acceptable to the people of Fiji’ unquote

Clearly Beddoes said the decree issued at the start of this process on July 18th 2012 fully intended for the draft to be made public and for the people to make their views known before the CA commenced as the CA debates were to incorporate the views expressed by the people as envisaged by Sec 8 (1) (c)

Had the Regime remained ‘honest & sincere’ to its commitment to this process and followed the provisions contained in their own decree 58, the draft document would have been released after being presented to the President and we would today be engaged in debating the contents of the draft constitution and not wasting our time on ‘why it was leaked’?

Beddoes said after the public submissions were closed and the preparation of the draft well underway it would appear that the Regime must have learnt through its ‘mole’ at the Commission the draft was shaping up to be quite ‘tough’ on a government, especially in the area of ‘accountability, transparency, human rights obligations, as well as being subject to legal challenges, and not being able to receive any further immunity if they were to consider a Coup 5

At the same time the PM learnt [from the same mole I would imagine] that the Commission had obtained the services of Ratu Joni Madraiwiwi as a casual consultant on Fijian issues, [which they had every right to do]. Now despite the fact that Ratu Jone’s contract had only a few days to run and therefore about to become a non issue, the Regime proceeded with the release of Decree 64 of 2012 dated October 31st 2012.

Beddoes said this decree was essentially to amend sections of Decree 58 so that the Commission had to publish each month a list of staff, Commission members and consultants and their salaries & allowances to try and embarrass Ratu Jone as well as an account of its monthly income & expenditures.

But tucked away at the very bottom of the decree is the Consequential Amendment which was ‘slipped into’ the same Decree but which amended Decree 58 Section 8 (1) (c) which says quote ‘by deleting the words, and the views of the people of Fiji expressed on the draft constitution’ unquote?

This is the amendment the Regime ‘slipped in’ to effectively remove the right of the people to see and comment on their draft constitution.

But what has Ratu Joni’s contract and the demand for monthly financials from the Commission got to do with removing the rights of the people to receive and comment on their draft constitution?

Absolutely nothing Beddoes said!

So why did the Regime decide to ‘exclude the people’ from seeing their own draft constitution? What was their motive for taking such an extraordinary step, so late in the process?

That Beddoes said was the question the people need to be asking the Regime to answer!

Beddoes said if the Regime had not slipped in the removal of Section 8 1 c as they did, the matter of the leak would not arise, as the document would have been made public as originally intended and we would be having a constructive debate on the merits and demerits of the draft constitution ahead of the CA!

Instead Beddoes said, remaining ‘true to form’ the Regime

Denied the people the opportunity to view and discuss and debate their draft constitution

They have mounted a campaign to discredit their own appointee Professor Yash Ghai

Confiscated 600 copies that was meant for public distribution

Displayed its arrogance and utter contempt for the people of Fiji and their submissions to the constitution with its ‘symbolic’ burning of the proof copies of the draft in an attempt to ‘intimidate’ Professor Yash Ghai

Beddoes said all law abiding citizens who seek a return to democratic governance should be grateful to those individuals within the commission who exercised empathy and good moral judgment by releasing the draft documents as was originally intended by Decree 58 so that the people can remain engaged in the process and discuss and debate their draft constitution despite the Regimes underhand and questionable efforts to exclude them.

Mr Beddoes, the mole was none other than Sarka Kuto Nandan. Professor Ghai knew or suspected this, but not the Sarka's level of deception. In fact, Sarka's appointment was mooted by Khaiyum, and supported by Bainimarama because Sarka promised to keep them informed.Sarka is now in Delhi telling the world howhe was the key architect of the Draft Constitution, but singing a different tune to Khaiyum. Don't be surprised to see him back in Fiji and advising the Constituent Assembly.

All 599 copies were sequestered by police on the government's instruction when it learnt that the former chair of the constitutional commission, Professor Yash Ghai, was printing them contrary to law and planned to distribute them himself without the apparent knowledge of his fellow commissioners. The police action was to preserve the integrity of the constitutional process.

The only things that were burnt were some shredded printer's proofs of the draft document, which the police destroyed for security reasons.

The printed draft copies will be made available to the public when the assembly is convened. We requested Professor Ghai to observe due process and it is regrettable that he unilaterally took it upon himself to leak the draft document. The commission's work has ended and the next process will commence in due course.
