Amended political party decree shows desperation of Fiji regime

Confirmation the political parties decree has always been about killing off Fiji's established political networks because they pose too much of a threat to the unelected government.

The amended decree (see copy below) continues the campaign to annihilate political parties with the provision existing names and even acronyms are unacceptable.

The amendments in section three also warn off media from repeating the names of political parties (and their acronyms!) the regime outlaws, with threats of a $50,000 fine or five years in jail.

The newly-gazetted decree was released yesterday and come well after a decision and public announcement by the SDL party to rename itself the Social Democratic Liberal Party.

The regime cannot say it didn't know about the name change or deny the intent to ensure it doesn't have any rivals for any so-called elections it is planning.

Apart from this can you also follow up on AG desire to boost Muslim business at the expense of others. I recent case where famous Nadi exporter was only given 10k for setting up a state of the art export facility. This person exports nearly 4-7 containers of veggies a month giving much needed income source to poor farmers but AG wants to put him in competition by giving a Muslim guy (Nadi) 170k to set up similar facility. This Muslim guy has not even exported a kg of veggies still he is supported while those doing it get peanuts.

The attempt by Khaiyum and Nazhat to ban the use of the name "SDL" for the new party for Mr. Qarase's old SDL should not deter the group at all. history shows that from 1970 - 1987, 80% Fijians backed the Alliance Party of Sir Kamisese Mara, from 1992 - 1999, 80% Fijians backed the SVT of Rabuka, and from 2001 - 2012, the dissolved old SDL held the majority Fijian support. All, Mr. Qarase's group ought to do is register a new name such as United Democratic Party (UDP) or National United Front(NUF) and forge ahead with its supporters....

Lets get real.

The only criticism of this ammendment should be that it was not included within the initial decree.

It is totally unfair that any new party should be re-registering with an acronym used by a de-registered party. There will be many people who vote on that basis, not realising it is in fact a different party. If a new group was to come along and use the acronym SDL for a party whose name was 'Sad Demonic Losers' it would cause total confusion and unfairness.

As for parlimentarians they are voted by the people who can be from any area within society. The same parlimentarians are paid for doing a job by ALL and EVERY person who pays taxes in the country. The tax that is collected to pay their wage comes through such taxes as employment, VAT both direct and indirect taxes. YOU in reality employ them.

Due to the fact that it is YOU who pay their wages it is only right that they work 100% of their effort for ALL of YOU. To expect to be a politician and then thinking that they can spend a part of their time, which you are paying them for, representing an additional group that pays them as well is stealing your taxes for their own use.

Think about it, all hype for nothing.

The regime is more than desperate. It has, in its knee-jerk reaction to the SDL's intention to register as a new political party, introduced legislation - temporary though it might be - which in effect, unwittingly erases Fiji's political history.
With the latest changes, the media can no longer refer - by name - to any of Fiji's political parties which existed prior to 16 February 2013. That includes the Alliance Party which ruled Fiji immediately after Independence, the SVT etc.
The fact that this regime continues to move the goal post to suit it's own agenda does not augur well for the future of Fiji. Our future generations will be burdened with the task of having to undo many of the regime's self-serving Decrees, not because the intent of the Decrees are misplaced but, because of the self-serving short-sightedness and the haste with which the Decrees have been drafted.
The latest amendment to the Political Parties Decree is without question, aimed at the SDL party.
As we like to say, "You can take a Fijian out of Fiji but you can never take Fiji out of a Fijian". Similarly, you can force the SDL to change its name, but the fact remains - you cannot force its support base to change, overnight, their support for what the party represented.
Vuniwaqa's labelling of attempts by old political parties to use existing acronyms and symbols as "mischievious" is the height of hyprocacy.
It is not the acronyms and symbols that the regime fears. What it fears more is the fact that its ill-conceived notion of forcing change on the people of Fiji will in fact back-fire.
I have never been a supporter of the SDL. However, with the regime's juvenile attempts to keep its oppossition at bay, I find myself tempted to support any new party that the former SDL might wish to form. Whatever political party Bainimarama and Khaiyunm will form is now destined for failure because the self-serving and manipulative nature of their style of rule has now been laid bare for all to see. No matter how much the regime tries to re-write Fiji's history, the truth will always prevail, because in this day and age, the pen is definitey mightier than the sword.

Khaiyum and Bainimarama are very much afraid indeed. Whether the new parties will register with the same abbreviations or dissimilar acronyms, the illegal regime will still lose the elections. If they will try to usurp the choice of the people again, they will very much regret it.

The international community is closely monitoring what is happening and they expect a fair and transparent elections. Now, by moving the goal posts in the middle of the game, the illegal regime has become untrustworthy and has been regarded as a cheater. These are some of the reasons for Bai's and ASK's loss and the impending demise of their cause.

I have too have not been supporter of the old SDL nor the new SDL. But I will support the party now, whatever new name or acronym they will adopt.

The Fiji Independent Commission Against Corruption is now conducting investigations in the Western Division in relation to certain allegations leveled against a proposed political party of fraud while collecting member signatures.




FICAC said the claims have been made by some residents of Ba.




These are in relation to some agents impersonating Government elections officials to collect signatures for the particular proposed party.



Police are also investigating the matter.


he complainants claim that they only showed their voter ID cards and signed the forms thinking that it was a check by the Elections Office only to realize later that they were being signed up as members of a proposed political party.

By amending the Decree AFTER applications have been lodged, you are creating new rules which change the whole game. You can in fact be rightly accused of trying to influence the end result. The fact that they've chosen to make the amendment now, rather than at the beginning, shows how fearful the regime head honchos are that things will not go the way THEY had planned. The SDL, on the day it met to dissolve the party, had a show of support from a large crowd of young people -- youngsters who could easily influence their peers. So, this amendment is not so much aimed at trying to remove any confusion over political parties through their symbols or acronyms. It's more about trying to destroy the SDL. I am no supporter of the SDL and its nationalist ideologies. But, I have to ask the question - why go on a mission - at tazpayers' expense - to destroy a political party? If anything, the idea should be to encourage political parties to ensure there is an abundance of manifestos from which people can choose those they feel best suited to represent them.
The people of Fiji are not so dumb as to vote for symbols only or to follow, with blinkers on, political parties which have branded acronyms.
Following an election campaign, the majority of Fiji's people are convinced by the various party manifestos to vote one way or the other.
So, in effect, you can call a party by whatever name you wish, including demonic titles if that's your thing, but people will still judge for themselves the party that best represents their INTERESTS. That's human nature. And that has been our political history.
In the final analysis, people vote for what they feel most comfortable with - whether it be along racial lines, bread and butter issues or whatever. The point is they vote to CHOOSE their representatives. Unlike the current situation where we have unelected people, paid from the public coffers, telling us what to do and what's best for us on the one hand, and totally disregarding what we might have to say through the various decrees which prevent us seeking any legal redress. Unfortunately, this regime is not just focused on destroying any political opposition. It's assumed the people of Fiji are so dumb that they (regime) have a responsibility to dictate what's best for us.
Remember, despite all the negative comments about trade unionists, the Decrees only prevent them from holding executive positions within political parties. It does NOT prevent them from contesting the general elections. Why should they be prevented? If they're the only ones brave enough to speak on our behalf then they should be allowed to continue to do so, even in Parliament --- the money they earn doesn't matter if its earned honestly. Besides, we can always remove them through the vote. Can we vouch the same for the current regime?
And to make matters worse, even the media is being gagged so that people only get the regime's version of what is good for this country. $50,000 fines - now if that is not a blatant attempt to stifle free speech, what do you call it?

We read in the regime mouthpiece newspaper the Fiji Sun (19/2) that a 66 yo American tourist told the people of Fiji that "politicians and those elected into parliament should be made accountable for the way they govern the nation".
I guess nobody in Fiji knew that!
The American visitor also said "we hear that this government is doing well..." I wonder where he heard that? Did he hear that from someone in the Fiji Sun? Does he know whether the government he has heard to be "doing well" is accountable?
I agree with the visitor Fiji is a beautiful country .But at the present time it is a country with a bad government - a government without any accountability. It is a military regime that is riding roughshod over the people of the country through the power of the gun.
Let us not shy away from this truth even if we are only a short stay visitor.
Worse still let us not distort the truth by painting a false picture of "this government".
The people of Fiji have not consented to the mob in power to be their government.

The beauty of the decree factory is that the rules can be changed any time. But how much of this will the people of Fiji tolerate? When is the point in time when the camels back breaks? Do we have the regime that we deserve or are we going to wake up and do something? What about dignity and freedom? What about self determination and justice? How much more of this crap are we going to swallow before we come out and claim our human rights back? Me personally, I think that enough is enough!

I would like to humbly suggest before Wise Muavono's political party in Fiji tries to "make the world a better place" (Fiji Times 19/2) it should concentrate on making Fiji a better place for the people of Fiji living there.The rest of the world would be happy if Wise's party can just do that.
If Fiji becomes a better place it would add to the world becoming a better place.
Let's concentrate on doing our bit in our small portion of world geography.
Let's concentrate on getting rid of the military regime and restoring democracy for starters

Savenaca Vakaliwaliwa has jumped to an unfounded conclusion when he claims the asylum seekers from "Afghanistan and other nations love to spend the rest of their lives in Fiji" (Fiji Times 19/2). I think he has over-rated Fiji as these asylum seekers' final destination.
Fiji could very well be merely a transitory stage in these asylum seekers journey to a country where they would really love to spend the rest of their lives. Fijians seeking protection in Australia and New Zealand might give some indication where these asylum seekers' final destination might be.
We recall in the eve of Hong Kong reverting back to the control of mainland China the Tongans sold Tongan passport to Hong Kong Chinese who were planning to use it to get to the US and Canada !

INTERESTING NEW AMENDMENT TO MEDIA DECREE....

The latest amendment to the Media Decree allows for Fiji Broadcasting to enter into joint ventureships with foreign TV entertainment providers without the retrictions of having the joint ventureship meet the 90 percent local ownership requirement!!!
That begs the question: Is the regime providing enabling legislation to ensure FBC becomes a monopoly with regards to pay channels offering entertainment from foreign TV providers?
What happens then to Sky Pacific? Is it being throttled into bankruptcy?
Imagine the financial gain were FBC:
1. to enter into a joint ventureship with the IRB to provide Fiji coverage of all IRB-sanctioned rugby games including the Sevens?
2. to enter into a partnership with Australian, New Zealand and Super Six countries to be the sole Fiji provider of their rugby games?
3. to enter into agreement with Fox Movies and the Bollywood outlets to be the sole Fiji provider of their programs?
WHERE IS THE LEVEL PLAYING FIELD, SAYED KHAIYUM?
Is Riyaz Sayed-Khaiyum's poor financial management of FBC TV and FBCL being swept under the carpet by brother Aiyaz in the hope that this new amendment will bolster FBCL's hopes of turning red into blue/black?
Admittedly, the Decree says entertainment television. Now WHO gets to interpret what's entertainment, what's sport and what's news? The Sayed-Khaiyums of course!!!
If this is not bordering on corruption then what is it? One brother simply helping the other brother hide his vomit and flash a minty smile to the world????

I am reliably, and I mean RELIABLY told that the morale in the FEA staff is such at an all time LOW that highly qualified technicians and engineers are leaving in droves to either greener pastures overseas or here locally.
This has been attributed to the GUJI syndrome that Hasmukh Patel has brought from his term at Kasabias after being initially being fired from the FEA for non-performance!!
He is using the GUJI syndrome to show to the ILLEGAL powers that he that he is saving money and therefore deserves a HEFTY pay packet at the expense of the workers.
In the meantime, the workers are really, really milking the system by other devious tactics.
So, it is really a no win situation in the FEA at the moment!
I do not for one moment blame the workers!!

CHAUDHRY: Not at all, we didn't need to do that, the support from the people was spontaneous, they were too eager to support the application for registration. And we didn't have to do anything devious to get support from them. So as far as I'm concerned I've just written this off as just an incident probably started by our political detractors.

HILL: Who would be behind that and what would be their motivation?

CHAUDHRY: We have gone through this kind of thing, accusations against the Labour Party by our detractors at every election. We have lived with it, so I'm not worried about it at all. The support for the party is quite tremendous and only in Ba we're targeting only 500 signatures and we ended up getting one-thousand-67 signatures. We didn't have to do all this, so it's a ridiculous claim and that's what I call it.

HILL: Do you know the identities of the two people who've been spoken to by police about this? Are they Labour Party officials to your knowledge?

CHAUDHRY: I don't know, as I said the police haven't come to me and I don't know whether they've spoken to these people who are doing the registration for us. So I'll wait until I hear something from them.

HILL: Are you confident that the police investigation will get to the truth of the matter?

CHAUDHRY: Well I hope so because that's the purpose of it, but let's wait and see what the outcome is.

HILL: Could this case negatively affect the Labour Party's chances of being registered as a political party under the Political Parties decree?

CHAUDHRY: Well the decree is amended every day or every second day, whatever you want to say, and look I'm not worried about this incident at all.

HILL: They have issued an amendment to the decree just recently which appears on the face of it to be targeted at another party, the SDL Party. It says that no party's allowed to be known by the same name or acronym as a previous party. What do you make of that?

CHAUDHRY: Well I think they're targeting not just the SDL, but every party, what they want, they don't want any political parties as it is, so that's it. We can't have free elections in the country with no political parties, and this is absurd because I think they've lost all sense of fairness, all sense of what democracy is and how to go about restoring democracy in a country which has been facing … under dictatorship for the last six years.

HILL: It doesn't sound like you've got a lot of confidence in the whole process that's going on at the moment?

CHAUDHRY: Absolutely not, no, it's just a joke, we're like a banana republic and these decrees come out and decrees aimed at specific people, specific parties. I think the international community needs to take a very serious view of what's happening in Fiji right now. I'm speaking here as a former prime minister of Fiji, I think I'm very worried about the situation that our people facing. By the look of things there is no hope of Fiji being restored through democratic rule, constitutional rule, as we've known Fiji in the past, we've had coups before, but something like this at any time before, and I'm quite worried and I think the international community needs to take a serious look at what's happening in Fiji

Seeing Doesn't Always Mean Believing

A pastor went to visit a woman from his church before she was to have serious surgery. As he walked into her hospital room, he found her in the arms of a man who was not her husband. Stunned and embarrassed, he silently walked out. Later, he discovered that this woman's brother had flown in from California to comfort her before her surgery.

After that, the pastor said, "I could have told others I saw that woman in the arms of a man who was not her husband and it would have been a fact, but it would not have been the whole truth."

The press often does this in reporting what people have done. They confuse the facts with the whole truth. This results in half-truths that are really the worst forms of lies, because they are so believable. Gossip and slander are big on facts and short on truth. They unfairly destroy people's character.

The next time you hear something bad about another person, be sure you have more than the facts. Be sure you have the whole truth, for it is easy to confuse the facts with the truth. And most of the time, it's not your business to share, anyway!

Remember, there is only one perfect truth and that truth is embodied in the life of Jesus Christ.

I am rooting for Frank Bainimarama's government to win the next elections whenever it is held. They will win the same way the Qarase government had won. Actually that's not correct. They will win in a much more blatantly corrupt manner. And their win will be accepted by the international community not because the elections was "free and fair" but because they want to get back to doing business as usual. That scene has been acted out before both in Fiji and other troubled third world countries.
Now, I know you are waiting for me to tell you why I am rooting for the Bainimarama government to win.
It's because I am a die-hard Fiji soccer fan! No government in the history of our country has been able to get the Fiji soccer team to qualify for the World Cup. I am convinced that with all the miracles the Bainimarama government has been performing since it's illegal takeover of power it will finally end Fiji soccer's woes and get Fiji into the World Cup. Fiji might even go on to win the World Cup under Frank's benevolent no nonsense leadership. Bare in mind here that Frank's government has already made unprecedented headway in ending racism, corruption, bad governance, and the coup culture in Fiji. Winning the World Cup will be a minor task for the Frank government.
Now I hope other sensible people will also root for Frank's government to win the next unprecedented free and fair elections in Fiji.
Vote the Bainimarama government for Fiji to win the World Cup!

I'll be rooting for you as you root for Frank's government. As you inferred, he's likely to win by a landslide (and I'm sure you weren't hinting at the sliding Frank did down the cassava patch in 2000!!). As you so eloquently pointed out, his government has performed countless miracles - including taking over the reigns of the Fiji Rugby Union and re-grouping our young Sevens warriors into all-time losers. That major feat, has led to sponsors like Asco Motors withdrawing and re-grouping themselves, probably with the intention of tripling their lucrative sponsorship deal?? I'm sure with Dr Sahu-Khan now out of the way, Frank will now perform another miracle with Fiji Soccer. Who knows, he might even captain the Fiji team to save FFA some money when they offer to pay his way (and his son's of course) to the World Cup. Aiyaz Sayed-Khaiyum won't need FFA funding - he's made enough from his time as A-G and will probably offer his services for free as the water boy - just so's he keeps close to his main boy - VB.
All sensible people in Fiji should root for Frank's government - not because he needs their support but because it's the most sensible thing to do. The idea is to root with your enemy - if he wins, you stand to be part of the rorting; if he loses, you get the chance to root him.
As I said, and as a friend of yours, I'll be rooting for you as you root for Frank .. and if Frank wins, I'll probably root you the next time I run into you at Laucala Beach!!!! Cheers Mate!

Guidance, Not For Reporting

Dear Editors,

This is a time of great political activity, and I understand your respective organisation’s strong desire to provide robust coverage of developments as they take place. Our desire is for you to do that as well.

It is all of our responsibilities – under the Decree – to present the Fijian people with a clear picture of the process leading up to the election. However, there has been some confusion about the recent amendment to the Political Parties Decree. This advisory is intended to clear up any such misunderstandings.

• Until an entity is registered it is not a political party and cannot be misrepresented as a political party by members from within the entity or in reports by the media.

• Pre-existing political parties that did not register by the deadline, or failed to be registered by the Registrar, or are wound up by the Registrar, may be referred to by name, but it must be made clear that the party no longer exists. (For example : “Ms X, of the former/deregistered ABC party, said…”)

• Proposed political parties that have submitted their application to the Registrar for Political Parties – but who have not yet been registered –can be referred to by name, but the report must make clear that it is referring to a proposed political party, not an existing one. (For example: “The proposed XYZ party made its application to the Registrar for Political Parties yesterday…”)

• Until an entity makes an application to the Registrar for Political Parties – at which time they become a proposed political party – the report must make clear that the group 1) is not an existing political party and 2) that the group has not yet applied to be registered (For example, it is correct to report: “X,Y, and Z met today to discuss the formation of a new political party, and are planning to apply under the name ABC…”)

• The name of any proposed new parties will be announced at the time they make their application to the Registrar.

I suggest people including government read the research paper titled "Enforcing migrant workers' rights in the United Arab Emirates". To assume the governments assurances which are not really thought it, but rather just stated can be very dangerous.

Fiji Times, Wesley, O’Flaherty handed severe penalties

Fiji Times Limited, its Editor Fred Wesley and former Publisher Brian O'Flaherty have today been convicted of contempt of court and handed down severe penalties by Justice William Callanchini.

Fiji Times has been fined $300,000 and this has to be paid within 28 days.

The newspaper company also has to pay $2,000 cost to the Attorney General's Office as the applicant in the case.

Fiji Times Editor, Fred Wesley has been sentenced to 6 months imprisonment suspended for two years.

He also has to pay $2,000 in costs to the Attorney General's Office.

O'Flaherty has been fined $10,000 and he also needs to pay $2,000 in costs to the AG's Office.

Fiji Times and Fred Wesley also have to arrange for an apology to be directed to the judiciary of Fiji.

This is a contempt of court proceeding where Oceania Football Confederation Secretary, Tai Nicholas made comments about Fiji's judiciary in the Sunday Star Times in New Zealand which was published last November and a day later was reprinted by the Fiji Times.

Justice Callanchini said Fiji Times must accept the ultimate responsibility for the publication of the contempt.

He said the newspaper company cannot hide behind its special position that has been acquired over its many years of publishing in Fiji.

Justice Callanchini said this is the second conviction of contempt of court for Fiji Times as it was fined $100,000 for the first conviction in 2009.

The High Court judge also highlighted that O’Flaherty cannot divest himself of any of his responsibilities by simply saying that he was not at work that day or that the material was published because junior staff or even more senior staff did not follow the system.

Justice Callanchini said Fred Wesley also cannot divest himself of culpability by claiming that he was not at work on the day in question and he must accept responsibility for the failure of his staff that were at work.

The judge highlights that Wesley is directly responsible for the content of each and every edition of the newspaper.

On the question of remorse, the judge says the not guilty plea taken by Fiji Times, Wesley and O’Flaherty was on the basis that the article did not amount to contempt of court.

All the fines and costs have to be paid within 28 days.

He hogs on this blog from australia and thinks he is the only smart person. People like him who deserted fiji for personal and material gains should focus on his adopted country. But he got on tthe wronG side of the aussies and is enjoying the dole and spend aLl his time here.

Can he enlighten us what good he did in fiji before he left

And since when has this regime released ANY of the public auditor reports? If what you're saying is true, publish the auditor's report.

I know he is not the gun toting type. he infact got exempted from cadet training to train for the school soccer team! I don't think he has handled a real gun in his life and ever will. he is anti-gun and anti-war. no someone else will have to be selected for that role.and, another thing nobody should make the mistake of attacking QEB . the Fiji army is stronger then Napolean's army!!

political party with a new name?How
about The Fijian United Party;Fijian Nationalist Party;Fijian National Front Party;
I'm sure the Fijians are very tired
of all the bullcraps and are ready
to vote just about any party other
than the one associated with Bainimarama or Khaiyum? So go on Tupeni register a new party and if
you need help to get membership,we're here for you?

Somehow I seem to recall seeing Rajend in his school days stroll from Vomo Street to NHS in green khaki - on Fridays like everyone else... I could be wrong, but my recollection is that the only ones exempt from cadet at the time were females and those assigned to library duties. That, as you would know, later changed when females began an all-female platoon around about 1973/74. But you must have to admit, Rajend did bring some pride to that school with his soccer skills!!!
As for an attack on QEB, I agree with you - it would be a mistake, not because the Fiji army is stronger than Napoleon's but because QEB has become nothing more than a residential compound. All the weaponry is at nine miles and at Berkley Crescent while all the active soldiers are no longer in uniform but are now outfitted by Lala's Store and sitting in cushy government offices (are you also among them?). And all the QEB sharp-shooters have been assigned to them as bodyguards!!! So, yes, an attack on QEB would be a mistake - in fact it would be an exercise in futility. But identifying Ex Natabua(ns) who support Frank's regime is not too difficult an exercise - Just look at the PS Tourism!

You sure you're not mistaking ballu khan for rajen naidu !ballu khan used to be hot on the cadet and commandante thing! the former Fiji rep left winger, lawyer turned school teacher saheed mohammed had got an exemption from cadet training for his elite soccer players. no rajen was not into those silly military style drills as far as I know.

I, as a true and proud Bauan, in all its true and real sense am very, very ASHAMED and saddened at the goings on and ramblings [albeit hot air] of Nailatikau!!
He does not deserve the respect, the allegiance, the support from us Bauans, leave alone the rest of the kaiviti dina of this country.
He is the direct opposite of what a Chief should be; A person who puts the welfare and interests of his people first before his own. A chief who is humble. A chief who is sets examples. A chief who is God fearing. A chief who is familiar with the aspirations and fears of his people. But then again, what do you expect when he is NOT a true Bauan. He is just there for himself!!
