Constituent Assembly key to Fiji regime's cunning plan

More analysis on where the regime may be going with the Constituent Assembly and the Constitution.

There's growing belief the boffins behind the scenes are drafting a Constitution based on the Singapore model.

The most pertinent provision in the Singapore model is the role of the Constituent Assembly in appointing a new president and others to Parliament.

Sources tout elections will be held for the Parliamentary seats but as per the Singapore model, the president will appoint a prime minister and cabinet ministers, not the Parliament.


They say the reason most political parties have been targeted by the new political party decree is because the regime wants to eliminate them from the Assembly so when it votes for the new president, there will be no stopping Frank Bainimarama from assuming the role.


Insiders say, though, that Bainimarama 'first needs trusted people in camp', which he doesn't have at the moment. 

The police commissioner is said to have too many correspondences with the diplomatic corp and is a threat. 

"He can only assume executive authority and hold elections if he brings in his trusted men to administer with the trust that they will not coup him," says an insider. "That is not possible unless he brings back Pita Driti or Esala Teleni, which the AG is not in favour of happening."

The prime minister's role will be a temporary position. 

It's believed that when Bainimarama assumes the higher office, it cannot be handled by Aiyaz Sayed Khaiyum because he has no support from the army and police so there is a good chance of a public revolt unless a trusted person can be appointed to run the daily activities of the prime minister's office.

Sources insist that as earlier suggested it might be Esala Teleni who 'commands respect from army, navy and police' who becomes the lynchpin.

"Unless Frank can solve the above issues he cannot take up office on the high hill - period."

To recap, under the Singapore model:
1) The president will be elected by the Constitution Assembly, who are selected by the prime minister
2) The term can be up to six years and after that two terms of four years before a new president is appointed.  
3) The president will nominate the prime minister and cabinet, who will not necessarily have to be parliamentary members.
4) The president can also nominate at least 9 people to Parliament who have not contested elections.

As of today because of the decree, no political parties exist and it will be weeks before they are formally re-registered. (Bloggers may recall that the dangers of the cunning plan of the regime were voiced several weeks ago by FICTU general secretary, Attar Singh)
Just two parties have registered, the National Federation Party yesterday and the Fiji Labour Party a few hours ago, with SDL saying it has time because it's a new party.

FLP has also lodged its appeal with the courts but the way the Fiji courts are operating today, doesn't bode well for the last minute bid to thwart the political decree.

Weeks ago Coupfourpointfive urged political parties to unite and boycott the Constituent Assembly. Last week we also had high hopes a leader would step forward and unite Fiji but even with Bainimarama in France and Ioane Naivalurua in Indonesia, no one has seized the opportunity.

And yet there has been no better time for people to show solidarity, starting with political parties uniting, a boycott of the Constituent Assembly, even a rally. What will it take?

I think it is a situation which will have some very unpleasant results for the regime because I don’t think these political parties and the people that support them would sit idly and see a corrupt regime, an unaccountable regime and unelected, and most importantly an illegal regime as pronounced by the Court of Appeal in the Qarase-Bainimarama decision, seize assets which belong to the people. We the Fijian people really thank Mr. Aiyaz Khaiyum for a well thought DECREE FOR POLITICAL PARTIES REGISTRATION. Well two former NFP members, Attar Singh and Parmod RAE, who used to deceive the voters had resigned and opted to remain as Unionists. So really, these two gentlemen were the few former politicians who were wasting our time as voters. They said that they will come back. My advice to these two guys don't bother coming back because you can’t serve two masters at one time and just keep your bulshit in your ass. Mr. Khaiyum pse this should be also part for the non-negotiable provision to be incorporated in our new Constitution. Please Mr. Khaiyum can you look for more loop holes where this sick politicians are taking advantage of and incorporate it in our non-negotiable provisions within our new Constitution. This is something that they have been fooling us over the years and enjoying it. Police are investigating information in relation to a proposed political party gathering member signatures by allegedly posing as government officials.

Spokesperson, Inspector Atunaisa Sokomuri said their officers in the Western Division are looking into the matter.

We will have further details later on these allegations leveled against the proposed party and also speak to the Acting Prime Minister and Minister for Elections, Aiyaz Sayed-Khaiyum and Registrar of Political Parties, Mere Vuniwaqa.

Rumors are rife that the PM AND AG are corrupt. Their side deals are in big money, gone are the days of talking in thousands.
One such rumored deal is the hush hush on the case of Guji businessman Champak Kapadia. It is said that he has reached a deal through a middle man and has paid PM and AG for his freedom. This case can without any doubt afford it and also pay offshore. This is certainly not good for the PM or the AG as such rumours do give credibilty to the fcat that corruption still exists at the very top level and in big dollars. If one has the contacts they can get whatever they want from the Govt. If these are actually rumours than we will wait and see if this high profile case does actually come out and if it dosnt than we all know why.
So whats the difference between Qarase, Frank and Aiyarse? Qarase supposedly made millions, the other 2 guys are making multi millions.

With regards to Pat Chute's assertion that a priest like Fr Barr should confine himself to Church duties and not involve himself in politics, Leo Nainoka quite charitably tries to educate Mr Chute on the broader dimensions of the scripture (Fiji Times letter 15/2). Nainoka contends that a priests work with the poor and for social justice and fairness must invariably take him into the realm of politics. I agree.
But let me approach the issue from another angle. When did Mr Chute realize that it was not right for a priest to be involved in politics? He didn't when the head of the catholic church petero mataca was handpicked by the coup leader Frank Bainimarama to chair the Peoples' Charter project. Infact he didn't when Fr Barr was working for the regime and was regarded a regime backer - an important figure for the regime's image and propaganda. It was only AFTER Fr Barr's falling out with Frank Bainimarama that we came to hear of Mr Chute's concern of priest getting involved in politics.
I wonder why?

No word on when High Court will decide on legal action

"There is no word as yet on when the High Court will decide on the legal action papers filed against the Political Parties Decree by the proposed Fiji Labour Party.
Although the proposed FLP applied for re-registration with the Registrar of Political Parties yesterday afternoon, they are against certain sections of the decree.
Meanwhile, Mahendra Chaudhry has confirmed that he is the proposed party leader of the proposed FLP while he also remains the General Secretary of the National Farmers Union.
We have established that Chaudhry has taken this step based on the fact that the decree restricts people who are elected or appointed to a trade union position.


The National Farmers Union falls under an industrial association, not a trade union.


We are seeking a clarification on this from the Registrar of Political Parties, Mere Vuniwaqa.

Minister for Defence Joketani Cokanasiga is expected to return to Suva this afternoon after completing his tour of the community posts in the Western Division.

Accompanied by the Commissioner of Police Brigadier General Ioane Naivalurua and a few of his officers, Mr Cokanasiga spent yesterday visiting community posts in Sigatoka and Nadi in his bid to assess the security situation on the ground.

4-year-6-month-old girl allegedly raped

Yet another shocking case has come to light where a 4-year-6-month-old girl was allegedly raped by an 18-year-old in Tavua.

The alleged incident occurred between 3am to 5am yesterday.

The 18-year-old farmer allegedly entered the bedroom window where the children were sleeping.

The mother reported the matter to Police.

More than 50 cases of rape have been reported in just over a month this year and the number continues to rise.

Psychologist Selina Kuruleca said urgent action needs to be taken.....

Commodore Bainimarama has formed a habit of blaming everyone but himself for the tragic decline of the sugar industry in the past four years under his stewardship as Prime Minister and Minister for Sugar.
He told a recent meeting of the International Sugar Council in London: “Six years ago, my Government inherited a broken industry characterised by neglect, mismanagement, political interference, self-promoting trade unionists and corruption. It was used by some careless politicians as a way to win easy votes. But these votes were never translated into meaningful change.”

“So we have set about trying to right these wrongs with a comprehensive series of reforms, but there are still many challenges to overcome. Cane quality, cane transport, general infrastructure, supply to our mills and the performance of those mills are all issues”.

In doing so, he blithely ignores all industry data which clearly indicate that the rapid decline in the sugar industry set in after he took over power in 2006 .

Let’s look at the real facts of the case: A month ago FLP published industry data going back some 18 years which puts the entire issue in its proper perspective.

These figures sourced from FSC’s annual reports show that in 2006 the industry produced 3.22 million tonnes of cane and 310,000 tonnes sugar. Since then there has been a dramatic decline with cane production this season down to 1.6 m tonnes and sugar make estimated at around 150,000 tonnes.

Can Bainimarama in all honesty blame “self-promoting trade unionists and careless politicians” for this?

It should be noted that this decline took place at a time (from April 2009 onwards) when he had banned all political and trade union activities in the sugar sector beginning with the National Farmers Union.

The sugar industry is not the only sector in serious trouble. All economic and social indicators are pointing downwards since he took over power – a contracting economy, record low investment levels, ballooning debt levels, rising inflation, unemployment and escalating poverty:

Implications of the Political Party Decree

1. Membership requirement – this is not a problem. The Party has in fact collected more than the required signatures and I must commend those members and officials who have worked hard to ensure this. The willingness of people at the grassroots to sign the forms, shows that FLP’s support out there is still intact.

2. The $5005 registration fee is high and will pose a deterrent to many parties; political parties in Fiji do not as a rule charge subscription for membership of the party;

3. There is the danger that even though we comply with all the requirements of the decree, the regime will find some means of deregistering the Party – there is enough scope within the ambit of the decree to find a reason for this

4. It should not be forgotten that the Registrar is not independent – she is the Permanent Secretary for Justice and comes directly under the control of the Attorney General. The Registrar’s impartiality is thus suspect from the start.

5. Even if the Party were to overcome the initial hurdles and get registered, operating a political party under the very stringent rules and financial regulations will be quite difficult. Source of funding will be a problem – donors’ names, addresses and other details will have to be disclosed. In Fiji, in practice, donors tend to be unwilling to have their names openly associated with political parties – least of all under the current repressive climate.

6. Some of the requirements of the decree are not difficult for the FLP – we already have branches in all districts – maintaining records will not be a problem. We have always been multiracial both in intent and practice. In fact, FLP has been the most multiracial party in Fiji – this is reflected in our electoral wins… the high number of Open seats we grab.

7. Our main objection is with the draconian, undemocratic, repressive requirements of Decree 4 which go against the guiding principles of the Fiji Labour Party:

- The Decree is an assault on individual privacy, and the freedoms and rights of individuals. The requirements for financial disclosure are not only onerous, they are a violation of peoples’ right to privacy.

- It is a violation of the civil and political freedoms of an individual, specifically the right to peaceful assembly and association as enshrined in the United Nations Declaration on Human Rights;

- It is in breach of core ILO Conventions which grant trade unions and their members freedom of association including the right to form and become members of political parties

- It also breaches international Conventions that allow freedom to organize and operate political parties without State interference and unlawful restrictions
- it is a breach of people’s right to form regional parties if they wish or those based on issues such as environmental parties not likely to have broad national appeal

- The severe penalties imposed under the Decree are clearly designed to deter the people of Fiji from forming and supporting political parties.

Fiji's department of immigration has confirmed that there are people who are seeking asylum and refuge in fiji because they fear for their lives in their home country (Fiji Times 16/2)
Nobody has that fear in Fiji's military dictatorship except that former military top dog Ratu Tevita Mara who has fled to Tonga for fear of his dear life. Everyone else in Fiji is happy and going about their lives without any fear at all and they are all speaking their minds freely - because the dictatorship is encouraging them to do so because of it's commitment to human rights and democracy,public accountability,transparency, good governance.
I wonder why the people are still so reluctant to speak their minds and openly criticize the regime?

Australian politicians have called off a visit to Malaysia after Independent senator Nick Xenophon was refused entry and detained pending deportation (Yahoo!7 News 16/2).
The group comprising Senator Nick Xenophon, Liberal MP Mal Washer, Nationals Senator John Williams and AlP MP Steve Georganas were planning an unofficial visit ahead of Mlaysia's upcoming elections. They were to meet opposition leader Anwar Ibrahim as well as Malaysia's minister in charge of parliamentary affairs Moh'd Nazri and members of the group Bersih, the Coalition for Clean and Fair Elections. Senator Xenophon was told there was a technical glitch in his passport and escorted to an area of holding cells. He was eventually told apologatically by immigration officials that he was on a watchlist and that there are orders from above in terms of security concerns and he was to be deported on the next flight out. Senator Xenophon said he has been and remained critical of Malaysia;s human rights record. But his key concern at this time is that they have found some serious system concerns about Malaysia's upcoming elections...

Australian Foreign Minister Bob Carr says" Senator xenophon's detention is a surprising and disappointing act from a country with which Australia rountinely maintains strong diplomatic relations" (yahoo news 16/2).
This act will help bring home to the Foreign Minister that Malaysia is a country that is routinely mentioned for its human rights record by human rights watchdog bodies - both Malaysian and international.But there is a tendency to put this conveniently to one side and continue diplomatic and other relations as if the human rights matter was not all that important in the larger scheme of things.
That's precisely what's happening with regard to the restoration of diplomatic relations with the military dictatorship in Fiji.
Will Bob Carr be surprised and disappointed if tomorrow the Fiji regime decides to do the same to an Australian politician?

Dakuwaqa knew how to stop him, but his plan required two minutes of commitment to Fiji. That's where it failed. Apparently not too many Fijians care enough about Fiji to commit even two minutes to her.

Tha problem is people do not know where the problems lies.People are starting to compare Qarase and Bainimarama.Thay have nothing in common except that they are both ethenic Fijians.Politically Qarase was democeratically elected to parlimwment,.Bainimarama self proclaimed PM after illegally taken over the government.Acadamically Qarase is a Gradguate from University and economist,Bainimarama no qualification.Stealing from Govt Cofer FICAC could not prove any case against Qarase for corruption.They only managed to hook him for abuse of power a decision he made but he did not have any benefit out of it which by right is a civil case but due to the preasure from Bainimarama and Kaiyum Qarase was sent to prison for one year.Bainimarama his cases are still waiting for him.the killing of CRW soldiers,and the treason thuis is what Bainimarama is frighten off and that is delaying the constitution because he is trying to avoid facing court and he would like to hang on to power. If Qarase can accept the court verdict and rulling and surrender himself to prison why is Bainimarama trying to avoid.Be a man face the consequence of your own act
