Fiji regime didn't put any money into Ghai Constitution review

The illegal Fiji regime had all the reasons to trash the Yash Ghai draft constitution because it had NOT put in any money towards its work.

Financial accounts of the now disbanded Constitutional Commission, obtained by Coup Four Point Five, reveals the illegal Fiji government only made available the parliamentarily complex to the Commission to house its offices.

All money and funding for the work of the Commission came from overseas governments.

The Commission’s accounts were audited by PricewaterhouseCoppers (PWC).

It reveals the Commission received just over 1.6 million dollars in donations to carry out its work.

The funders were:
Australian Aid - $601772
American Bar Association - $59648
New Zealand Aid - $582510
British High Commission - $108330
European Union - $248054

The whole audited accounts does not reveal anywhere that Frank Bainimarama’s illegal government put in a single cent towards the Commission.

It seems the illegal government made a decision right from the beginning that they were not going to accept Yash Ghai’s recommendations, therefore they did not financially support the work of this Commission.

It definitely would have been wasted tax-payers money if the illegal government had financially supported the Commission, and in the end trash its work.


Observers say Frank Bainimarama and Aiyaz Sayed-Khaiyum had no hesitation in rejecting the work of the Ghai Commisssion because they knew it was totally overseas funded work and they wouldn’t lose anything.

What started in 2006?
No election was called but a Coup was instigated ==>
PM => Dr Senilagakali then Bainimarama
Government=> Military council then bogus cabinet
Legality => coup declared unconstitutional and illegal in 2009
then what went wrong folks?

Being a former civil servant I know that PSC Award normaly given to the most hard working civil servant throughout the year and its not for poilitical figures. Can Serulagilagi and Katonivualiku enlighten us of the criteria to be met by anyone to be qualified for that award ? Or is it just the masipolo of Serulagilagi and Katonivualiku so that they can continue working in government untill they are 100years old ?

The NFP has broken away from the coaloition signalled the fact that they do not want to work with other races especially Fijian. This is not suprising. NFP was alaways indian dominated party and that they want to remain at that which is a sign of selfishness and racist. Initiallty when the three major party NFP,Labour and SDL weree in the coalition it actually brings hope to majority of people of all races in Fiji that the time has finally arrive for a better and pisotive multiracial political climate looming from the horizion come 2014 election. The NFP is going nowhere on its own. Its electoral base is too narrow, and its only elder with true leadership qualities is Attar Singh, who seems to have been locked out of the leadership.

The FLP is going nowhere on its own, either. It's too MPC-centric, and MPC is too MPC-centric.

The PDP is the Party of Appeasement. Its members are nothing but riffraff.

Any party created by the regime will be the Party of Treason. Its members will deserve to have a bounty on their heads.

SODELPA needs to serve as the core of a broad, multiparty coalition showing multiculturalism, with kai idia in visible positions of leadership. With the NFP choosing -- foolishly, in my view -- to contest the elections alone (if there will be elections), SODELPA needs to build that coalition with the FLP.

The FLP needs SODELPA every bit as badly if it's to remain relevant. Its electoral base is narrowing, and it needs new leadership. Chaudhry is perceived as too opportunistic snd amoral to provide credible leadership for the long-term.

We are generalized and classified as mean people with self interest as our paramount character. However self interest people are mainly capitalists. Majority Indians are however socialists in nature, are peaceful, non violent and cultural people. This illegal regime is hopeful to win the 2014 election but pls lets look at another scenario.

If they loose the election,
Will Bainimarama relinquish his position as FMF Commander. In the mind of the Dictator (as usual like Mussolini, Hitler. Idi Amin etc), he will never trust anybody but very good in manipulating the minds of people through visible provisions, development and pay rise etc.

History will always repeats itself....the next Commander will kill its predecessor.

He can not appoint Naivalurua because Naivalurua has learned his lessons well. He also is thinking and planning for his next move retire completely or make another move.

Bai will have to appoint some one he can control and manipulate.

Who is the MOST likely choice will be the guy that has the balance of suspicious power.

There are some very young and well educated Military Officers around who can take Fiji forward and do the job as expected for a young and progressive democratic states like Fiji.


One good thing about democracy is that it will always use the long arm of the law to fairly judge and prosecute people irrespective of age,time and space, as had taken place else where in the world.

All the perpetrators and
instigators of the COUP plus all corrupt activities (illegal) committed by people at high places will one day face justice.

People must realize that situations and circumstances influence how people think and do things.

But circumstances can change any time which can also change things around for the good or worse.

So much is being said in the dailies of late concerning Fiji Basketball and it's intentions to make the cut for the upcoming 2016 Olympic Games in Rio and to host the Oceania Youth Championships in 2014. According to their development officer they took along a 15 year old school kid on the woman's team for exposure. The Fiji Times Sports team should do some investigative reporting on Fiji's after match/final night function at Aotea Lodge in Porirua and the drinking party involving management and the players from both the mens and women's teams, that went on all night until 11am the next morning. Aotea Lodge had to refund every other non-basketball tenant's money for that particular night after continuous and regular complaints from them about the noise coming from the Fiji camp. I am proud of my fijian and maori heritage and I watched every game both men and women. It was quite obvious from his glaring body language that the women's coach Lai Puamau gave up on his team after their loss to PNG. He basically sat in the back row and sulked for every game after the PNG loss and right up until the last game. We are not going to get anywhere near the Olympic Games if we have officials with this kind of attitude let alone make the grade at the Pacific Games in PNG in 2015. Long lost acquaintances should never compromise the mission of the team and the promises and potential achievements that his excellency the President spoke about when the teams presented their itatau to him prior to the departure. Unfortunately Tunai Waqairawai(Wellington), Nemani Kobiti and Saula Koroi's get together was more important than the reason for them being there in the first place. What a shame. If I was a parent of a player on the women's team I would be knocking on Basketball Fiji's door demanding an explanation for this grievous breach of trust on their part. This is the least we can expect of adults in management positions.

The only reason Frank and Aiyaz are trying so hard to put the fear of god in the RFMF is it secure the RFMF against betraying Frank.

Once he steps away from the RFMF and into his political gumboots, he will want to make sure that he is safe from the RFMF choosing to do its job: i.e. protect the people from criminals like Frank and Aiyaz.

The Prime Minister and Army Commander has told members of the RFMF that racial differences in the country must go out.

Commodore Bainimarama said that is why the military had to take over the government and make changes.

He told young soldiers and new recruits that they did not experience the difficult times they faced in 2000 when some soldiers were shot at QEB.

He said some former politicians and chiefs who were members of the Great Council of Chiefs used their chiefly status to call meetings and speak on racial differences.

Commodore Bainimarama said at one time the chiefs and former politicians met in Parliament and they were praising each other.

He said the chiefs mixed their positions with politics and that is why the Great Council of Chiefs was abolished.

Commodore Bainimarama stressed today that the GCC is not coming back although some politicians are still saying it should come back.

He told the soldiers not to be swayed easily by the former army officers who have resigned and are talking from outside opposing the military.

The Army Commander said the soldiers should be strong and stay focused in the upcoming elections.

Commodore Bainimarama then sent out a clear message to the soldiers that if they do not like what the military is doing then there are two gates at the camp and they can walk out.

He also told them that when they first joined the Army, a tabua was not presented to them to work in the RFMF as they wanted the job.

Commodore Bainimarama also called on all the members of the RFMF to get a copy of the 2013 constitution and read it as it is written not only in English but in vernacular.

He highlighted that as Fiji is preparing for the 2014 General Elections, one very important non-negotiable in the Constitution is that racial differences must be abolished.

The soldiers had the church service and they then had morning tea.

Members of the RFMF have a Christmas Dinner tonight.

Could it be, the only reason Aiyaz told Frank to send those troops to the Golan Heights, was to give them both an avenue to remove from Fiji, any Soldier who might be showing themselves to be a possible threat to the Regime and themselves.
It might back fire, once they begin to trickle back to Fiji.
The good thing about the Golan Heights deployment is, the Soldiers will now be able to grasp just how bad Fiji Society has deteriorated under Frank Bainimarama, because they will have something to compare their Country with and because they will notice the changes, which if they remained in Fiji, are so subtle, they otherwise would not have noticed those changes.

BE careful when leaving houses empty or when coming out for a night in town, says the police.

Director operations ACP Rusiate Tudravu said police had noted an increase in reports of house break-ins and mugging.

"Vacant houses have been targeted. So it's wise to alert your neighbours that you will not be home," he said.

"Police is doing its best to increase patrol. There is a no-leave policy currently in place. Everybody is working right through the Christmas holidays."

ACP Tudravu agreed that muggings were becoming a regular occurrence.

He said the offence was also committed in the city areas.

Nitin Lal, 25, a technician of Namadi Heights in Tamavaua, said he was mugged a fortnight ago.

"I came out of McDonalds, Suva after a meal. It was after midnight. Just between the front door and the taxi bay Sukuna Park, I was mugged," Mr Lal said.

"Two men grabbed me from behind and then just like a swarm, up to 10 boys appeared out of nowhere and started punching and kicking me, I knocked out. They took my wallet and phone."

They are trying to create an unstable environment so that Bai will have a legitimate excuse to post-pone the Election.

Where else can you organise 10 men (as Nitin Lal says above) to be in Sukuna Park in the middle of the night waiting to jump a person.
Only the Army can organise this sort of gathering and not be interrupted by the Police?

I wouldn't be surprised if the Army is behind an increasing number of these violent acts.

The regime put no money into Ghai's phony (un)constitutional dia/monologue, but Fiji's traditional friends sure did. A big waste of money, as anyone who understands this regime could have told them, and did. Well, some of the donors probably knew the money would likely be wasted, but they wanted to be seen making the gesture anyway.

Ghai got his money, though, didn't he? Even though all of his work went into the rubbish bin, and Fiji got nothing out of the process but another heartbreak. The regime got more window dressing with which to try to mask its tyranny, however.

Ghai says little now about his Fiji experience. Why isn't he crying out to all and sundry about how the regime used him so cynically to foist an illegal constitution on the nation of Fiji? For the same reason that rape victims so often choose not to testify in court. Dakuwaqa warned him to flee whilst he could, with his virtue intact, though his dress be in tatters. Instead, Ghai chose to suffer the regime's indignities and take its money, then go on with his career as a "constitutional expert", like nothing ever happened.

GROWTH in the Fijian economy increased to 2.25 per cent in 2012, supported by income tax cuts, and low interest rates, said the International Monetary Fund in its latest review on Fiji.

After its executive directors finished consultations with the government last month, the IMF said in its report growth was going to continue in 2013 and with the promise of elections in 2014, it predicted investor confidence in the economy would continue to grow.

In its assessment, IMF said it was particularly important to expand Fiji's capacity to utilise effectively an expected increase in foreign and domestic investment following a successful transition to democratic parliamentary government in 2014.

However, unemployment remains stubbornly high at nearly 9 per cent, with youth unemployment and underemployment at significantly higher rates.

Emigration pressures continue especially among the higher skilled, the IMF stated.

It observed that fiscal policy was rightly balancing the need to strengthen the fiscal position against the need to increase growth-enhancing public investment.

It welcomed plans to reduce fiscal deficits, while increasing capital spending to clear infrastructure backlogs.

The report said Fiji's financial sector was stable and international reserves had stabilised to a comfortable level.

And inflation declined as imported commodity and food prices moderated.

The IMF said macroeconomic policies were broadly appropriate as Fiji's fiscal policy continued to balance the need to strengthen the fiscal position against the need to increase public investment to support growth.

According to the report, the 2013 deficit target of 2.8 per cent of GDP was on track to be met, with strong VAT revenue collections and somewhat slower-than-planned expenditures in the first half of 2013.

IMF noted that key policy challenges remained to sustainably raise economic growth, reduce poverty, and increase resilience to shocks.

The report said to achieve higher growth and reduce unemployment, faster and deeper structural reform was urgently needed.

It welcomed the reform of the Fiji National Provident Fund, while noting that potential risks arising from the option of lump sum payment would need to be managed carefully.

While welcoming the overall soundness of the financial sector and the rebound of credit growth from low levels, it called for enhanced monitoring of sectors with rapid credit growth.

In the event inflationary pressures emerge, the directors advised using open market operations to reduce excess liquidity and, if needed, tighten policy rates.

They noted the continued gradual appreciation of the real exchange rate and called for periodic reviews and adjustment if necessary.

The IMF also saw merit in more flexible exchange arrangements and encouraged the authorities to eliminate remaining exchange restrictions and to continue to strengthen the Anti-Money Laundering/Combatting the Financing of Terrorism (AML/CFT) regime.

It welcomed the recent progress in structural reforms. However, to raise Fiji's potential growth, it called on Fiji to reduce its vulnerability to shocks, and alleviate poverty, it saw a need for deeper and faster reforms.

The IMF said priority should be given to improving the investment climate by streamlining government regulations, relaxing price controls while protecting the most vulnerable, increasing the efficiency of land use, and upgrading the infrastructure.

It said efforts were also needed to increase the energy supply and ensure the viability of the sugarcane industry.

On balance, the IMF report seems to be favorable to Bainimarama's recent economic management in broad terms. But on the other it warns him against creating yet another shock to investor confidence by failing to hold elections in 2014.

That shock is widely expected and so already partly discounted in the market. If/when it occurs, the reaction will be one of great dismay followed by another economic downturn, in turn followed by more apathy and an attitude of ho-hum on the part of both Fijians and foreign governments. International financial institutions like the IMF will always be ready to make loans, but investors will continue to sit on the sidelines until legitimate governance is restored.

In my book, he's been let off the hook too easily. He told us not to be cynical. Our friend Dakuwaqa explained that it's the regime that's being cynical. But did Ghai give heed? No.

That's because Ghai himself was a cynic. Any constitutional scholar would have understood clearly from the outset that the regime had no mandate to create a new constitution, but Ghai went along with his pupil Aiyaz Sayed-Khaiyum's pretense anyway, in order to make money and add more credentials to his résumé. In fact, Ghai openly admitted that he included immunity and other provisions in his draft "constitution", even though he knew it was opposed by what seemed the great majority of Fijians, because of pressure from the regime. He eventually complained of its massive interference with the work of his commission, but he did nothing more than that. He just carried on the charade, instead of following Dakuwaqa's advice to throw a hissy fit and leave.

The regime was only using Ghai, but he knew it, and it was mutual: he was also using the regime. He had the gall to warn us against too much cynicism, but let the record show that the true cynics were proved to be the regime and Ghai.

No self-respecting constitutional expert would have accepted the Fiji military dictatorship's assignment for the crafting of a new constitution for the country when a properly constituted court of law had ruled the regime to be unlawful.
why did Yash Ghai accept the assignment?
and in so doing lend credibility to the an otherwise unlawful enterprise?
what was his PERSONAL agenda?
Perhaps Ghai is just a constitution making merchant.
If that is the case then the trashing of his draft constitution would have been no real loss for him.
He would with time ply his constitution making trade elsewhere.
The real losers are the people of Fiji who have been foisted with a self-serving military government designed constitution.
Ghai must share the responsibility for this imposition on the people of Fiji.

There is never any guarantee that dictators will accept their work. It's part of the risk that al parties are aware of, and wiling to take since it's considered a worthwhile gamble. Sometimes gamble doesn't pay off. very few people are willing t relinquish power willingly. you just have to recoup losses and move on, as ghai has done. that's how it is.

We learn from 'Mum queries on's death' (Fiji Times 24/12) that a Macuata woman Ashni Devi whose 21 year old son Ravneel Singh allegedly committed suicide at the Namaka Police Station in Nadi last week is demanding answers from authorities on how he committed the alleged act while in their custody.
The grieving mother has every right to demand answers from the authorities. Powerless people tend to get ignored by State authorities. Human rights practitioners in Fiji therefore need to get right behind the woman.
A 21 year old man is not expected to expire suddenly after being taken into police custody.
But we all know strange things have happened in the "new Fiji" being fashioned by the Bainimarama military regime.
This case reminds me of the death in custody of a 24 year old Aboriginal man not too long back after he was taken into "protective custody".
Nobody believed the police story and an appropriate commission of inquiry was established to ascertain the true circumstances of the death.

Fiji is not a broken democracy. Ours is a working democracy that was betrayed and subverted through treason. Fiji's democracy and its constitution were functioning and peacefully evolving. It was betrayed by the very people whose job it was to defend it. Bainimarama justified his betrayal on the basis of needing to 'fix' the system, but all can now see his true aim was saving himself from accountability for his crimes.

It's not the job of constitutional experts to help dictators impose new constitutions on another people, especially when the dictatorship is illegal and those people think their existing constitution already adequate. That's exactly what Ghai was doing. He even, by his own admission, included provisions in his draft constitution that were anathema to most Fijians just because they were demanded by Bainimarama.

Ghai is gutless. Ghai knew, or should have known, the duplicitous nature of this regime when he accepted the assignment. No bonafide constitutional expert interested in drafting a constitution that genuinely reflects the national will would have entered into the assignment without certain preconditions to ensure the integrity of the process. Ghai was either derelict in not setting such preconditions or gutless in not enforcing them. And look where Ghai is today. Is he vehemently and vociferously speaking out against the regime's subversion of Fiji's constitutional processes or the way it so cynically manipulated him for its own selfish ends? Not at all. He simply took the money and never looked back. So I agree with Mere -- Ghai acted just as cynically as the regime.

A MACUATA woman whose 21-year-old son allegedly committed suicide at the Namaka Police Station in Nadi last week is demanding answers from authorities on how he could commit the alleged act while in their custody.

Ashni Devi of Tabia said she did not believe her son hung himself under the watchful eyes of police officers.

"Ravneel Singh (son) was working at his uncle's timber yard in Nadi for about two years now and he was alleged to have raped a girl, whom we know was his girlfriend," she said.

"I really don't know whether the allegations are true or not, but one thing's for sure — I want to know how he committed such an act in custody.

"Where did he get the rope from and where were the police before the incident. I just want to know because this is something any parent would ask if it happened to his or her child."

Mrs Devi assumed her son may had been afraid of going to prison.

"We don't know what was going on in his head before he passed away

"I doubt that he committed suicide. I just want answers so I can sleep well at night."

Police spokeswoman Ana Naisoro said the CID was conducting an internal investigation into the matter.

Bainimarama thinks that the itaukei race,the military and the chiefs are his own property and he can do what ever he wants with them.To our soldiers I have never seen a bunch of asshole. What Yash Ghai did was dishonourable and dishonest. He lent his credibility to a pack of traitors and thieves who clearly were only interested in consolidating their gains through a phony constitution contrived to give them immunity and continued power. Talk about distractions -- this bullshit exercise led us on a merry chase for two years, wasting our time in worthless submissions, sowing divisions over differences that would never be taken into account anyway, Sturm und Drang to preoccupy us whilst the regime robbed us further.

Ghai disregarded our constitution, dishonestly choosing instead to buy into the regime's myth of "abrogation", despite surely knowing, as a constitutional scholar, that a nation's constitution cannot legally be abrogated in such a manner and under such dubious authority and circumstances. He knew that his commission had no mandate or authority from the Fijian people to rewrite our constitution, but he did it anyway. He also knew his commission wasn't remotely representative of the Fijian people, consisting instead of foreign carpetbaggers and regime quislings.

Ghai put loyal Fijians in the unfair position of having to choose either to enter into an unconstitutional process of "consultations" with these commissioners hand-picked by the treasonous regime or run the risk of having the legitimate interests they represent marginalised, with the blame unfairly laid to their "voluntary lack of participation" in the regime-skewed process.

Any transgressions throughout my life have always been due to my own miserable choices but never ever due to the advice, guidance and shepherding of the good men and women who've dedicated their entire lives in guiding folks like me who may fall short of God's glory but never of his inexhaustible divine mercy - that which I am forever grateful for - and am constantly reminded of esp. on this special day when we are born anew in the LIGHT AND HOPE THAT DWELLS AMONG US...

Perhaps you lot ought to direct your 'false anger' and complaints to the taxpayers of the donor countries who paid his team and generously employed Fijians who worked with Professor Yash Ghai.

And didn't the Fijian regime benefit through taxes paid to them? Please tell the regime to return all that tax money to the donor countries ASAP! Very shameful to hold on to it and continue their "werewere ubiubi"... The world knows that dictatorships do as they please, no matter what help and goodwill is extended to them by well-meaning do-gooders such as the donor countries and Yash Ghai team. It's the nature of the beast. It's self-preservation.

Yash Ghai's job was to take consultations, based on that craft a constitution, and submit to the authorities. His job ended there. what Fiji did with he constitution was Fiji's business, not his. It was not for Ghai to pre-empt what Baini might or might not do with the constitution. it was beyond Ghai's control anyway. to suggest otherwise as some simpletons are doing is sheer stupidity and naivety.

Ghai had no business drafting a constitution for Fijians in the first place; Fiji's constitution is for Fijians to write.

Fiji already has a constitution. Most Fijians do not want to see it scrapped; we want to see it unfailingly honoured and punctiliously observed.

The traitors who overthrew our democratically elected government deserve to hang. They are the last people who should be involved in shaping our laws, much less rewriting our constitution.

Foreigners like Yash Ghai do the Fijian people a supreme disservice by working with these traitors, and Fijians who actively support them in their treason deserve to hang beside them.
