Parties to tackle Electoral Commission

Fiji's political parties are due to meet with the newly-appointed Electoral Commission next week. NFP, SODELPA, Fiji Labour Party and the Peoples Democratic Party were contacted by the chairman, Chen Benn Young. The meeting is expected to focus on a number of election issues, some of which are raised in a letter by the FLP.

We welcome the appointment of the Electoral Commission and look forward to working with it to ensure that the 2014 general elections would be free, fair and credible. The people of Fiji are looking forward to the restoration of democracy and constitutional government after eight years of repressive military-backed rule. 

The FLP realizes that the Commission faces a difficult challenge, not the least of which is to set up an independent electoral machinery practically from scratch in a short time frame of about six months, if the elections are to be held in September, as promised. Your Commission may well be apprehensive about its own functional autonomy and authority in light of the fate of the Constitution Commission headed by Professor Yash Ghai. 


Be that as it may, you will admit that the current environment is hardly conducive to the holding of credible elections. People and political parties are still not free to express their views openly. Draconian decrees restricting the right to freedom of association, expression and assembly continue to remain in force. With elections due in September, there is a dismal lack of preparation and the electoral process remains under the control of the regime and its Attorney General. 

We admit that you have just been appointed to office but we believe that the Commission needs to move fast to take charge of the process, if it is to gain the confidence and approval of the people of Fiji. 

The Fiji Labour Party has a number of serious misgivings and reservations about the process as is currently in place. Of equal concern is the restrictive environment in which the nation is expected to go to the polls. 

We believe that it is the Commission’s duty to insist that the basic rights and freedoms of the people are fully restored as provided for in the Constitution, if the upcoming elections are to be regarded as free, fair and credible. To this end, the Commission will need to engage with the regime to obtain a satisfactory outcome acceptable to the people and in conformity with internationally accepted norms for free, fair and credible elections. 

The FLP Management Board seeks an urgent meeting with members of the Commission to discuss these concerns and to get the Commission’s views on how it intends to address them. 

Main areas of FLP concern: 

1. Lack of preparedness for Elections :- Supervisor of Elections is yet to be appointed. As a result, staff in the Elections Office operate without direction or an approved work plan. Matters relating to recruitment of appropriately qualified staff and their training for the conduct of the elections remain to be finalized. This unsatisfactory situation is likely to continue until the appointment of a Supervisor of Elections. 

2. Electoral Legislation and Regulations have not been promulgated and there has not been any consultation with the political parties on the subject. 
We are reliably informed that the legislation drafted by the Technical Assistance team (EU, Australia and New Zealand) was handed to the Attorney General sometime ago and that it is being reviewed by the regime’s legal team which will finalise its contents before promulgation. It has been suggested that the draft legislation may be revised or amended as the regime sees fit, with the possibility that it may not conform to international norms. 

It would have been proper to first publicise the draft legislation for public comments and consultation with political parties. As matters stand, and judging from the experience of the Ghai Commission’s draft constitution, it is not unlikely that the regime’s version of the legislation may not be in conformity with internationally accepted norms. Should this happen to be the case, then the integrity and credibility of the elections would be seriously compromised. 

3. The Elections Office is still controlled by the Attorney General. This must cease forthwith. The electoral machinery must function completely independent of the regime. 

4. A significant 20% of eligible voters are yet to be registered, according to statistics obtained from the Elections Office. FLP had suggested to the Permanent Secretary in charge of Elections to consider house to house visits by elections office staff, particularly in settlements and villages in both rural and urban centres, as in the past, to ensure maximum possible registration. There has been no response to this request. 

5. One-day elections. The logistics of holding elections within one day, given Fiji’s geographical and other constraints, is mindboggling. The civil service does not have the capacity and the resources, let alone adequate numbers of experienced and trained personnel to successfully conduct credible elections in the very short span of just one day. 

This issue needs extensive discussions/consultations with senior civil servants and political party officials who have the requisite experience in such matters. 

We are informed that only 40 copies of the 2014 Budget Estimates were printed for use exclusively by government departments/ministries and that copies of the document are not available to members of the public/ organisations wishing to buy them for their information or use. 

It is thus virtually impossible for anyone to accept that credible elections are possible in such an oppressively controlled environment.

Lastly, we deem it important to ask the Chairman and all members of the Electoral Commission whether they would be prepared to declare 

• their assets and liabilities, including those of their spouses and children (under 18 years), such declaration to include details of any Contracts (including employment contracts), Assignments or Deeds entered into between them (in their individual or professional capacity) and the State or any para-statal institution or organization. 

• Membership of statutory Boards, including Boards of government commercial companies (GCCs) either in their individual or professional capacities. 

All such declarations to be published in the media for public information and the cost of publication to be met by the State. 

You will note that all candidates contesting the elections – whether political party sponsored or independents – are required to make such declarations under the Political Parties (Registration, Conduct, Funding and Disclosures) Decree 4 of 2013. 

We feel strongly that if candidates contesting the elections are required to make such declarations, then it is only proper that those in charge of the conduct of the elections should consider doing the same in the interests of transparency.

    Mahen's good buddy Madigan made sure his boy (RC) didn't get locked up for tax evasion or made to pay compensation to the clients he ripped off.

    Only in Fiji. Nothing is ever as it seems. I know a friend of RC's in Sydney. He claims RC talks to Madigan via email. Nothing would surprise me.

    If Fiji’s economic figures are farked up then Chor ( as previous minister for finance) must take a good portion of the blame.

    The FLP still doesn't understand how this works. The elecions will be free, fair and credible because the Commander will declare them as such after first deploying the army to guard the ballot boxes.

    The Electoral Commission needs to learn from the Professor Yash Ghai experience and just do as it's told.

    Everyone is free to express their views openly. And we're free to bring to the camp anyone who does.

    The Commission already enjoys the confidence and approval of the people of Fiji, just like the Commander and AG.

    The Commission will need to engage with the regime to obtain a satisfactory outcome acceptable to the people. That's the only engagement it needs.

    Internationally accepted norms are one thing in New York and Geneva and another thing in Suva and Labasa.

    Fiji can accomplish one-day elections. The army will see to that. One-day campaigns are another appealing idea.

    40 print copies of the 2014 Budget Estimates are plenty. Only certain government ministries need to know how much we're spending and on what. The public has no need to know. It just needs to keep paying us its taxes.

    The Electoral Commission shouldn't have to declare assets and liabilities, any more than anyone else in the government of the day. They're not politicians.

    I am from Lau and can vouch that Jale has the full support from the province and from we've witnessed from other provinces he has been to like Lomaiviti and Kadavu. He spends more time in these constituencies than in the Solomons. We don't give a hoot about SODELPA. If those so-called leading candidates in SODELPA think he does not qualify for leadership then we would not mind if he joins another party. Our support remains with him because he is honest, hardworking, wise, humble and wins our hard earned trust.

  51. Let's assume that the elections wont be rigged.

    Over the last 7 years, I have had the opportunity to meet people from all sections of Fiji. I noted, especially around a beer, that a good deal of Fijians are strongly against VB. We don't get that feeling from the media because of censorship, which prevails ( we hardly read anything against the regime and there is an over-exposure of VB in the medias) So my first point is that SODELPA/SDL still has a strong base, I would say about 30% to be conservative. FLP has also a strong base, with respect of the declining indo-Fijian population, I reckon they will easily get their 20% votes. NPF is a mystery, but could get 10% and PDP is another mystery.

    That being said, the above percentage are on the low figure, and could easily be higher. It seems that VB didn't do the maths, and I fear that if he loses, he wont have the choice but to stage another coup.

    Funny enough, VB got so angry at the SDL during. 2006 when the PM said that his defeat could lead the a coup.... and now we realize that FB's defeat could also lead to a coup.... that's creazy.

    I attended the FNPF Roadshow at the Lautoka Waterfront Hotel this afternoon, and guess what?
    A respected pensioner and I think a resident of Lautoka came up with THE sterling suggestion and request if the FNPF may seriously consider paying us fortnightly as opposed to the monthly payment!
    We, the pensioners present were MORE than pleased that we were assured that the Management of the FNPF fully understood our predicament and were assured that the kerekerek would be taken on board.
    SO, to all you pensioners in the other Divisions, when the roadshow comes your way, make sure you ALL back the kerekere from the West!!

  59. We should expect thisr egime to do what it has always done, which is to lie and cheat. So when (not if) elections aren't held, or they're not fair, then we should be ready to act immediately.

    The vanua should take the lead. Its leaders should agree with the UFDF and each other on a secret plan of mobilisation. Their emissaries should discreetly approach the genuine leaders within the Methodist Church to coordinate with them. The Methodists should discreetly cultivate the Catholic leadership. The UFDF should inform reliable labour leaders so they're ready to lead a general strike. The UFDF should bring riendly foreign capitals in on the plan. Patriotic members of the RFMF should identify likeminded soldiers and sailors and be ready to move swiftly.

  70. Mahen is a liar, an opportunist, a womaniser, probably a crook, and certainly traitorous for helping to empower Bainimarama's dictatorship. But he's also helping to lead the charge now against this treasonous regime. That means a lot and requires some physical courage, especially after the ordeal he went through in 2000. His party's stance against the frauds perpetrated by the regime are generally well-reasoned, moderate and useful. He doesn't deserve to be PM, but MPC's actions in resistance to the regime since 2009 should mitigate some his treason charges when justice is restored to Fiji.

    Why do AG and PM still rule? The answer lies in the national character of Fijians and its three major philosophical pillars: Kerekere, lamusona and liumuri. The principal of kerekere is the expectation of unearned income, the desire to obtain handouts without investing any effort. From the very beginning Bainimarama played to this aspect of Fiji’s national character. Price controls, reduction of electricity tariffs below supply cost, subsidised bus fares, sewing machines for the peasants, electricity and water supply for villagers etc. With little of no dignity the masses keenly lap up the crumps that are thrown by the rulers who have gorged themselves on state money.
    Closely related to the desire for unearned income is the deeply ingrained fear of authority and the general cowardice that is so evident both amongst the general population and their rulers. The legendary cassava patch sprint of Bainimarama is as impressive as runner done by Mara who had the chance to change the game as commander of Fiji’s largest military unit the 3FIR. In line with lamusona philosophy he decided to run to Tonga.

    Lamusona is perhaps the strongest single characteristic of Fiji’s population, which is quite obviously not prepared to take even the smallest risk in return for some dignity or self-respect. No matter how blatantly the regime abuses power the entire population has cowered down and hopes that somehow, someone from Australia or elsewhere will change things around. When Qarase had the chance to mobilise the population against military dictatorship, he begged Australia for an intervention instead of taken up the fight.
    The third pillar is liumuri or backstab. Liumuri is the safety valve for a subservient population prepared to bend over for the rulers on a daily basis. While the average Fijian does normally not have the opportunity for liumuri, the elites have. Those urban professionals who have lost their jobs and their influence under the Bainimarama regime want to get back at the ones that have taken away so much from them.

    It is tempting to see race as the key to Fiji’s political instability. The large Indian community has remained culturally distinct from the ethnic i-Taukei community. As a result, most institutions are either predominantly i-Taukei or predominantly Indian, creating a divide across Fijian society that is prone to widen in times of political and economic stress.

    But the reality is more complex. At the community and individual levels, Indo-Fijians and i-Taukei coexist harmoniously. There are historic tensions within the Indian community based on income levels that echo the religious, regional, and caste differences in their country of origin. The desire to backstab a competitor is as strong in the Indian community as amongst the i-Taukei.

    Tensions within the indigenous Fijian community come not just from historical rivalry of clans and confederacies, but also from the stresses of a communal society that is adjusting to the pressures of a modern economy by trying to backstab competitors and opponents. It is clear that the socio-cultural fabric of our society provides the most attractive environment for military coups and dictatorship.

    THE Anthony family of Nakasi in Nasinu had harboured hope that their only son would be inducted at the Assemblies of God High School prefects' investiture on Friday. But this hope was dashed when Lawrence Anthony, 18, died at the CWMH early on Wednesday.

    While dad Anand Lal Anthony wouldn't apportion blame, he said the sad part was that his family wasn't given a satisfactory explanation of Lawrence's sickness during his two days in hospital.

    He claimed that four doctors had given him four different explanations of his son's sickness.

    "Lawrence had to be rushed to the CWMH on Monday morning because he was shivering and felt cold all of a sudden. From there we left everything to the medical professionals because they are the experts," Mr Anthony said.

    "He was admitted for two days in the Intensive Care Unit (ICU) and I was told by the first doctor he had a virus in his blood.

    "The second doctor told me his kidney and liver were giving up and they prescribed medicine and pills which I bought because I wanted my son to get well

    "On Tuesday morning, another doctor told me Lawrence had very high dengue fever.

    "I was really confused because I had been already told of two different sicknesses, however, both were not symptoms of dengue fever."

    Mr Anthony said that since he wasn't a medical expert, he had to accept what the doctors told him.

    He claimed that the last doctor to see his son informed him Lawrence had suffered internal bleeding.

    "Despite all these, my son was alive, talking, breathing and even recognised people.

    "On Wednesday morning, I called the staff in charge before 3am and they told me Lawrence was doing well, that there was a slight improvement in his condition.

    "But at 5.48am, I received a call from a staff member to tell me my son was no more."

    Mr Anthony said he still couldn't understand how these qualified medical professionals couldn't agree on an explanation of his son's sickness.

    Students of AGHS also visited Lawrence's home on Friday and presented his prefect's badge to his parents.

    The Health Ministry confirmed in a statement an 18-year-old male died at the CWMH on Wednesday morning.

    "The deceased was in a critical condition when presented to the CWMH hospital on Monday (03/02/14) and was admitted into the ICU.

    "The post mortem report confirms that the deceased succumbed to internal haemorrhage in particular to the lung and the heart."

    Mr Anthony said since he wasn't a medical expert, he had to accept what the doctors told him.
