Fiji media chairman to appear in court

Raj: Harassed media and regime critics on standards but now appearing in court
Media Industry Development Authority Chairman and failed PHD student Ashwin Raj, who is hanging to the coattails of Frank Bainimarama and Aiyaz Sayed-Khaiyum for his personal advancement, has been charged by police for annoyance.

A statement by the Commissioner of Police confirms the charge but police have not issued details of the incident. We have, however, established the charge arises out of Raj's use of abusive language towards a lawyer from he had recently bought a house from. 

The 21 Kikau Street property in Samabula belonged to Joshika Samujh, a lawyer formerly with the Consumer Council and now employed as a Legal Tribunal with the Ministry of Labour and Industrial Relations. 

Raj bought the two-flat house from Samujh - with the apparent understanding her mother would rent one of the flats.

At 6pm on Monday this week, Samujh came to visit her mother and was apparently confronted for no reason by an irate Raj who started using abusive language.

Samujh reported the matter to the nearby Samabula Police Station. At the police station, Raj directed his abuse at both Samujh and police officers handing the case. He was then locked up in a cell for 2 hours. 

Raj was later charged with annoying person, bailed and will appear in the Suva Magistrates Court on 13th February.

Bloggers will recall that Raj has been a real asshole towards media and critics pontificating about standards and values while defending the hypocrisy of the Bainimarama regime - many will no doubt be following his fate with interest.

I am quite perturbed by the level of public discourse in Fiji as we head towards a new beginning after the national elections. Media Industry Development Authority

PART 2 of the Decree outlines the structure and functions of the Media Industry Development Authority. The minister appoints the chairperson and five other members, and can also remove them. This is an obvious and major conflict of interest.

Section 17 provides the Authority immunity from legal proceedings, civil or criminal.

While the media is bound by restrictive rules and regulations, the media authority can act with virtual impunity. Where is the balance and fairness government is preaching about? Where is the accountability?

Section 22 states content must not include material, which is (a) against the public interest or order; (b) against national interest; or (c) creates communal discord. This is a very broad provision open to interpretation by the government. It is like a noose around the media’s neck. This provision is unnecessary because offences are already adequately covered under Crimes Decree, under the Public Order Act on racial and religious vilification, hate speech, and economic sabotage.

Part 5, covering enforcement, allows the Authority to force the disclosure of specified documents or information as well as the right to enter, search and confiscate documents.

When its comes to breach of confidentiality, the standard practice in democracies is that it referred to the Courts, which rely on precedence, and can be expected, to come up with fair, impartial judgments. In Fiji, this function has been usurped by MIDA, which is controlled by government through appointments made by the minister.

This is yet another noose around the media’s neck.

The Ratbag has committed a crime and so he should shut his big trap up and remain silent until he is declared guilty in Court. Then he can maybe kick up some useless fuss about the cost he has to pay or whether the jail term is too harsh. Other than that, please shut his mouth trap up!

“In some cases there are two people who are both claiming to be the rightful title holder. At times cases like these are brought up to us for a decision,” he said.

Whilst on Darmordar Coty, owner Div Darmodar of Darmodar brothers is in hot shit with Fiji Police. He has been living with a prostitute called Rowie Lal who is a known drug pusher too. Div had returned to his home but goes back to the flat for his poke every now and then. He funds her drugs and booze life and pays for her flat where all the illegal activities occur. Meanwhile a video is being circulated on facebook showing Fijian family members preparing a DOG lovo. Pictures included a hoisted already skinned dog, chopped up raw dog chunks in a huge pot, dismembered dog head being paraded around until all goes into the lovo. Pictures taken stage by stage.

Pictures taken after the lovo shows them all smiling ready for their dog meal with lovo dalo. Included is a pic of a small child eating a piece of dog meat while smiley faces look on.

Fiji is a country well known for it's poor treatment of dogs. Every week we read letters in the papers about stray dogs roaming the place because the owners do not look after them.

Everywhere we drive we see malnourished mangy dogs at the side of the road because the vast majority of dog owners do not care about their well being although the vast majority of owners purport to be people of Christian values.

So why the surprise when those cooking them in lovos are doing us all a favor and putting these unloved animals out of their misery.

On the surface, Americans appear to have much to be thankful for with regard to the degree of freedom and the amount of opportunities available to us. In general, we just seem to be the happiest people on the face of the earth. However, the data tells a much different story.

The United States is a nation in severe decline and it is beginning to show up in our mental health which is a reflection of the troubled political and economic times that we find ourselves in.

America’s General Mental Health Report

In 2013, over 9.3 million Americans had serious thoughts of suicide during that year. During that same year, 43.8 million adults (age 18 or older) experienced a diagnosable mental illness as 2.7 million (1.1%) made suicide plans and 1.3 million (0.6%) attempted suicide.

“The report by the Substance Abuse and Mental Health Services Administration (SAMHSA) also finds that 10 million adults experienced a serious mental illness and 15.7 million adults experienced a major depressive episode in 2013″. These results continued the same trend as was found in 2012, when the findings reached astronomical levels.

In 2013, major depressive episodes affected approximately one in ten (2.6 million) youth between the ages of 12 to 17. However, Americans do not get consistent treatment with only 38.1 percent of depressed youths receive treatment for serious clinical depression. The SAMSHA Report found that, approximately 34.6 million adults (this represents 14.6% of all American adults) received mental health care. These numbers are significantly escalated over the period covering 2002-2011. According to the new report, 44.7% of adults with any mental illness and 68.5 percent of adults with serious mental illness received mental health services.

The numbera listed above are indeed grim. The rate of mental illness is growing in lockstep with our failed economy. There is a definite correlation between the growing rate of mental illness and our obvious failures as a country. Over 20% of Americans have a diagnosable mental illness. Anywhere from 35-40% are receiving no treatment. This means that when the economy collapses, millions of displaced people with a significant mental illness will greatly exacerbate the coming civil unrest.

There is now evidence that Americans are far more mentally ill than our foreign counterparts.

This announcement was made by Prime Minister Rear Admiral (Ret) Voreqe Bainimarama at Vatukarasa, Sigatoka, this morning.

"Under this program which was a key plank of our manifesto for the election and is detailed in the 2015 Budget every household with a combined income of less than $30,000 a year will get an allocation of free water based on an international standard of how much water a person needs every day, which is 50 litres," he said.

Fiji held its highly anticipated election in September 2014, but does that make it a democracy?

There's much more to a functioning democratic system than people putting a mark on a piece of paper and dropping it in a box. Even the international election observers didn't go so far as to say the vote was free and fair – they chose their words with great care and said the result was 'broadly representative' of the will of the people.

Functioning democratic systems have several aspects to them, including neutrally applied rule of law, representative government, secure property rights and free speech. Fiji has problems in each of those areas, but one of the most significant relates to free speech and the role of the media.

During the period of outright military rule in Fiji, there were government censors stationed in newsrooms, checking every story before publication.

Those censors are gone, but local journalists I've spoken to say they are still cautious about how far they go in covering anything involving politics. They say they have a censor in their heads. And with certain media outlets having to apply for publishing or broadcasting licences for periods as short as six months, angering the Government is a risk they cannot afford to take.

There are many stories of late night phone calls from someone in a position of power to editors and publishers demanding that a reporter be fired or demoted for offending them with something they wrote or broadcast. These incidents are difficult to prove, of course, but what is undeniable is that journalists in Fiji are convinced this happens, and they adjust their behaviour accordingly.

Just as important, a culture has developed among those in power which is hostile to the very concept of robust journalism. Every reporter working in Fiji has experienced demands from those in authority that they be sent a list of the questions to be asked in advance of an interview (assuming they agreed to an interview in the first place, which is far from the case ordinarily). When, inevitably, reporters from outside the country refuse to accept such ridiculous conditions, the response is often anger. While it is perfectly reasonable for a reporter to indicate the general areas he or she would like to cover, providing questions in advance is completely unethical.

Also noticeable is a general reluctance of those in a position of authority to engage with journalists in a realistic way. Many times an Government department will simply issue a press release and tell reporters contacting them to use the release. Recently I myself had the head of a key Government body simply hang up on me for trying to get an interview about an important issue.

Visitors to Fiji can see this for themselves. Just turn on the television and watch a news bulletin. It is regarded as a perfectly normal thing for a newsreader to simply read out, in full, a Government press release. This is the sort of thing you'd expect to happen in North Korea, Zimbabwe or Cuba, not a democratic Fiji.

There is a culture in Fiji of not answering questions from journalists that has grown since the military coup of 2006, and the attitude towards the media, both local and foreign, was not particularly friendly even before then.

The danger is that these attitudes have become entrenched for the new generation of Fijian journalists and will be difficult to change. If you know that people in authority refuse to answer questions, or if they demand questions in advance, or they simply issue press releases that don't answer the questions the public wants answered, then after a while it becomes hard to do your job properly. Fijian journalists are caught in an impossible situation, and one can only sympathise. I don't know that I would behave any differently under similar circumstances.

If Fiji continues to treat its journalists as mere royal heralds issuing pronouncements by those in power rather than as tribunes of the people who find out what's really going on up at the castle and tell the villagers about it, then its status as a functioning democracy must have a large question mark next to it.

Sometimes I'm dumbfounded with the decisions and actions taken on by the illegal Frank Bainimarama. He behaves like he is suffering from serious dementia.

What happened to his foolish decree back in April 15 2009 declaring that within 15 days the mandatory retirement age was 55. This was supposed to include all civil servants, military, police and prisons. Well a good lot of unprepared civil servants from different departments had to leave their jobs. Can you imagine the panic amongst these citizens especially for those who were still paying off home mortgages and other loans, uni fees for their children etc etc etc.

So why is he still in office together with all the rest of the civil servants who are past 55?

Now we have Frank saying that retired teachers would be rehired into schools. He says the Opposition had criticised him. Well, of course they would! He is so friggin stupid and two-faced!

The demented illegal PM goes on to say:

“A lot of Opposition talk is nonsense. They do not realise that at one point in time there was no job for these teachers once they reach their retirement age,” he said.

What in tarnations is he talking about?

What about all those whom he mercilessly kicked out of the civil service, has he taken them into consideration too?

As you search Scripture to find how to judge evil and good, you need to apply it to your own life. Be sure that when you look in a mirror you see Christ reflected there.

“All scripture is given by inspiration of God, and is profitable for doctrine, for reproof, for correction, for instruction in righteousness: that the man of God may be perfect, thoroughly furnished unto all good works” (2 Timothy 3:16-17).

We all fall short of perfection and we all need to study Scripture and correct our own sin. Then we will be better able to help others out of their sin.

As the world draws closer to the final days, evil will increase and grow stronger. Don’t be afraid to judge, or form an opinion about what God says is sin and stand against it. Many people would rather live in darkness than come out into the light.

“But if our gospel be hid, it is hid to them that are lost: In whom the god of this world hath blinded the minds of them which believe not, lest the light of the glorious gospel of Christ, who is the image of God, should shine unto them” (2 Corinthians 4:3-4).

If someone accuses you of being “holier than thou” smile and take the compliment. If you stand firm on God’s Word the mockers will have been made aware of their wrongdoing. Take every opportunity to share the gospel with others. Tell them of God’s love and forgiveness. You may just open the way for a lost soul to avoid God’s final and eternal judgment.

FFP is bad, but SDL and other governments before it were hardly better. The poor performance and corruption of all past governments and their miserable failures, like NBF and Agri Scam to name just two, brought Fiji to its knees, forced people's hand, and they voted FFP.

My problem is that some people have very myopic views. Fiji has made shit progress in the 40 years since independence. FFP only came in last eight years. In 40 years previous government could not even build roads and bridges - just made bulshit promises and disappeared after getting the vote.

If Fiji First is not good, life under previous governments was hardly better. All of them were just as corrupt, if not more, starting from Mara, Rabuka, Chodo Chaudhry to Qarase. None of them were clean.

So get effing real. An no, I am not a FFP supporter. I just think we should have a broader view and be fair, and stop things like portraying Qarase as Mandela and choddo as Robin Hood.

One thing is certain and that is Fiji is living the present better than ever before and the future looks bright. I do note, though, that they didn't have the dictatorial powers the present lot has enjoyed for many years, they weren't as abusive as the present lot, and I don't feel they were nearly as corrupt, either, though that's not saying an awful lot.

But perhaps he is just following the paths of his FFP leaders in hoodwinking the people to gain popularity.

For one to be popular does not mean one is right. And to achieve a necessary goal through unlawful and unrighteous and dishonest means or measures does not even mean good governance. Many people unnecessarily suffer when leaders and governments resort to devious ways to acquire a desired outcome well meaning though the outcome may be.

The Methodist Church in Fiji and Rotuma has recorded a massive drop in membership of 110,000 over the past seven years.

According to church's general secretary, Reverend Doctor Epineri Vakadewavosa, membership has dropped from 300,000 in the 2007 National census to 190,000 as of August last year.

In an interview with the Nai Lalakai, Mr Vakadewavosa said the church was concerned, thus a meeting would be held in March to first clarify whether these figures were correct.

It is indeed very sad that some of Fiji’s best qualified and experienced professionals have been terminated through unscrupulous means in the past few years
Looking through termination procedures used by large organisations worldwide, I feel many employees in Fiji are being treated as criminal by those in seats of power.
It is common knowledge that an employee should be treated fairly and the termination process be handled in a professional way that preserves the employee’s dignity.
The employer should be careful about how much information is communicated to others about the facts and reasons for the termination. Learning about the reasons for the termination from media outlets without employees being first informed has become the norm in Fiji.
The departing employees should be treated with dignity, respect and honesty, while being given the appropriate information and support needed to make good decisions.
If the co-workers left behind feel the departing employee was mistreated during a termination, the organisation can quickly lose the trust and loyalty of the workers. The company is the loser.
I do understand that employers have a basic right to terminate the employment of an employee, but along with that right comes responsibilities.
Employers must comply with the employment/labour standards and human rights legislation for their jurisdiction and beyond that, employers must treat employees fairly and in good faith.
Some common grounds we know that are used for termination are: dishonesty where theft or fraud by the employee that is serious enough to warrant dismissal; insubordination where an employee repeatedly breaks organizational policies and meaningful and progressive discipline has not resulted in a change in behavior; and, incompetence where an employee is incompetent at his/her job and performance has not improved even though the employee has been given the tools, guidance, support, training and sufficient time and opportunity needed to improve.
If termination with cause is the result of a serious event, the onus will be on the employer to show that a fair investigation of the event took place prior to the termination and that the event was indeed serious enough to warrant dismissal from employment.
When employees expressed their grievances in the media and may eventually tale legal actions for their dismissal, these are indications that basic termination processes were not followed.

This letter no doubt covers the sacking of the two Fiji TV Executives.

We can expect more of this type of unprofessional and unlawful termination procedure from those in power (Fiji First) who through sheer malevolence will retaliate against those who are bold enough to expose their misconduct corrupt and illegal activities as we've seen in Tanya and Tevita's case.

What is the result of the autopsy into Jone Dimuri's death in the USA? Sakiasi Ditoka's brother died because karma is a bitch. Too much rubbishing the good work of Fiji First. How about Nemani Ramasei and Frank Robanakadu? There is a very good reason for Nemani Ramasei's anti government stance in spite of your low down below the belt allegations.

If you would care to check out many of his statements. Nemani's brother, Verebasaga, was murdered when he was apprehended by soldiers during Bainimarama's illegal and traitorous take over of Qarase's government.
